    Was just rear ended. Questions

I was just rear ended. Ugh. There were 2 cars in front of me on a 2 lane road. The front car had a weiner dog run out in front of them and slammed on their brakes coming to a complete stop. The car in front of me got over and slammed on their brakes. There was no where for me to go. I slammed on mine, stopping in time about 1/2 a foot behind the front car and all the sudden bam! The ford ranger behind me hit me and forced me into the car infront of me. Well the car in front of me took off for some reason. So the ranger and I both pull over and I get out and slam my door. Well I see she's crying so I calm down and tell her its alright etc. She's 16 and had got in a wreck 4 days earlier. I decided not to call the cops for some reason. I have too big of a heart. Well I got all her information and we parted.
    Couple questions;
Will she have to pay for both my front and rear bumper? Or is she only responsible for the rear?
Th bumpers will have to be replaced, could I possibly get USP bumpers?
I don't know how the payments and all that work, so work with me.
    This is my first wreck.

    Thanks
    Cameron

Dude - you should have gotten a police report. Now her insurance company will try to say that since you have front end damage that you were following too close or something, and that you are partially to blame.

Exact same thing happened to me in my Jetta - I was pushed into the person in front of me. $4500, and the person who hit me had to pay for it all - including the car that I was pushed into. I had a police report and had to be very firm with the other guy's insurance company regarding how it all went down.

I can't help you much about the insurance aspect but get your neck checked out. Might feel like nothing now but I have had friends/family think its nothing and its turned out worse than they thought. Catch it now before it gets in a worse stage, better safe than sorry.

if your insurance is paying for the damages to your car, you might be able to convince the bodyshop to order usp parts instead of regular parts. Also, get you neck checked out

If you REALLY want to be an asshole you could try to sue her if your neck turns out bad but that is dirty and I definitely wouldn't do it unless her insurance company tries to fuck you over with the whole front end damage thing.

There is just a small gash/hole in the front. Not real noticable but if her insurance will pay for it I most definitely will get it fixed. How does the process work? Do I go to the body shop and get a quote then contact her insurance company?
Also before contacting her insurance company should I contact her parents to see if they want to do it without going through the insurance company?
    Thanks

Re: Was just rear ended. Questions

its not too late to get a police report. atleast in my state it isnt... you can file a report within 24hrs of the incident, and any pictures you have will help. (you did take pictures at the scene right?)

also, i know its a long shot - but include a description of the car in front of you... they could be held liable too for fleeing, if they find the car that is.

i know it sucks, and i know you feel bad for her - but there's a good chance you're gonna get screwed on this one. lesson learned, call the cops then and there. the police won't do anything but help you in this situation - that girl's insurance is going to bone her either way... it just makes things much harder on you now.

Re: Was just rear ended. Questions

definitely make contact with people in this order:

    police
    her/her parents
    your insurance company
    her insurance company
    several body shops

numbers 1 and 2 may change back and forth, i just want to emphasize that all of this contacting needs to be done ASAP - preferably ALL within the next 24 hours. sounds like a lot, but if you want to come out on top of this you need to jump on this shit.

get absolutely every bit of information that you can IN WRITING. if you can get her to sign a statement saying what happened or even better - get her to talk to the police with you - do it. words are worthless when they're not on a piece of paper

people who don't call the cops after someone else hit them are foolish. I was going to write something far worse but I think you already know you made a bad choice.

go to a custom shop....if the new parts are equal in value to the original parts(new), you may be able to upgrade.

Talk to the girls parents right away, as well as insurance. if you were at a complete stop when you were hit. and then you were pushed into the person in front of you, and she will admit that. then you are ok......hopefully since you scratched her back, she'll scratch yours.
    work in progress....

Yes you should have gotten a Police report. People like to dick each other around when it comes to this sort of thing "TRUST ME" I see it all of the time. She is responsible for the damage done to the front and rear of your car.

Re: Was just rear ended. Questions

She would be responsible for all of it if you called the police. She isn't responsible for anything now. Trust me. I've been there. My car was hit when it was parked accross the street from me and I didn't call the cops cause the guy was drunk and I didn't want to send him to jail. Instead, I had him sign a paper saying that he hit my car. Afterall, he lived right accross the street from me. That is, until he moved to Florida a week later and I never saw a penny. I got the police involved afterwards but it didn't do anything. All I have to say is hopefully you have better luck than me.
