08 CVT issues?

I have an 08 A4 Convertible FWD with the CVT. I have noticed the past couple of days that when I take off I am getting a whining sound that follows acceleration. No other issues were noted.

Dropped the car off last night to get a new top and the shop called this morning to say the car didn't want to shift into reverse It Went into drive ok and finally did into reverse.

The car has 140k on it. No leaks in transmission as I recently had it in for service.

Am I looking at a failing transmission?
