In Virginia for most modern cars they need to pass visual for emissions. E.g. either or they can "see a cat" sometimes this is not possible because of how tight the spaces are in the engine bay, and the other part is not having a CEL or showing that the emissions system is still looking for readyness via obd2. What it really comes down to is if you are positive that you can eliminate the CEL with your downpipes, and that is typically done by using a O2 sensor spacer.
Personally if I am throwing money at chancing not passing emissions I would just get HFC's and call it a day. On my old cars they have typically shown no power reduction, they really just add heat more than anything, which can reflect in higher egt's but hopefully the flow will out weight that.
