Upon further review, I'm thinking that this may be a poser S6. If you look at photo hard enough you can see the outline of the passenger seat headrest which has the shape of the standard C6 seat and not the narrow S6 headrest.

I have seen this car in person, and spoken to the owner about it. It's a A6, however it has been swapped with an S6 drivetrain. It's very well done, but it's the only way you're legally getting an S6 avant here - make your own

Which is completely legal. There is no legal way (currently) to get a C6 S6 or RS6 avant stateside. Period. Any that claim to be here permanently are not legal, even if you dupe the people at the DMV to register it for you. The only way would be to petition to have it added to the eligible for import list, which requires crash testing and federalization (changing headlights, cluster, etc). Unless you get them to go with "substantially similar" to an A6, but that's even harder.
