FYI on EPL Tune and Smog Testing

I had to have my car smog checked in TN this week and decided not to take the tune off ahead of time on my '13 S7. I was pleased to see that it passed with no issues. In Nashville the test is really just making sure all of the sensors are in a ready-state and that it hasn't been mucked with, and I can safely state that EPL is doing it right.

Just thought others might be interested,

The Stage 2 jump is where you may have issues with smog testing as most stage 2 software disables the post-cat sensors. On the other hand, if you run hi flow cats and think that you can switch back to the stock tune for testing, your cat efficiency will likely read out of spec and you will fail

Bottom line.....if your state uses OBD based emissions testing, you have to be running the stock cats/O2 sensors unless you want to go the route of illegal ECU programming.

If APR was going to disable the secondary O2 sensors, why put in the bungs and extensions to connect those O2 sensors with the downpipes?

"Investment cast secondary oxygen sensor bungs
APR’s obsession to details resulted in investment cast oxygen sensor bungs that sit on top of the piping, preventing material from protruding into the exhaust stream, disrupting flow."

"Two high quality oxygen sensor extension harness are included as the catalysts and sensor bungs are relocated further away from the turbochargers."

The AMS downpipes have the cats and secondary O2 sensor location closer the stock locations, than APR.

I do agree with your analysis. APR's politically correct language could be interpreted such that the bungs are really just O2 sensor spacers that would allow the sensor to remain functional and still give an in spec reading to the ECU. However, no company is going to publicly call this an O2 sensor spacer, as everyone knows what an O2 sensor spacer is for.
