    Just got hit by a drunk kid head on

    Kid is 17. No license and could not produce insurance as he said they just got car. Hit me head on at 40 and we were going about 15. The blew 3 times legal limit for alcohol and had a backpack with a handle if vodka in car. He was arrested

    I thought I was dead. But I have no critical injuries nor my wife. Airbags deployed

    Any advice on how to proceed? How to be made whole. We want the car totaled and are afraid it won't be

    This luckily was the SUV and not the S5

    It was hard to not beat the crap out of him wasn't it. Glad you're ok. I think you're stuck with your insurance and a civil suit against him.

    Jesus Christ thank God you two are ok. Just make sure police made a report and you have ALL his info. Man would have been different story if you two were in the S5.

    I am glad both of you are OK. I have no sympathies for that 17 year old kid. He's irresponsible and cocky. Don't let him getaway with this. Yes, I have to agree with 14S4GWM. Claim damages through your insurance company and go after that brat for what he's worth. From what I have read in your post, it looks like the idiot is a spoiled rich brat (driving with no license, uninsured, and drinking Vodka). You didn't mention what kind of car hit you so I may be wrong in my assumption.

    Oh I will beat the Crap out of him. Just not physically. I will do it in a court and go after him and parents. That's why I was posting for advice or referrals. Or ways to get more info on this kid and family

    Damn.. Sorry to hear and glad you guys are Ok.

    Did he have any form of ID? I am guessing since he was arrested the police would of got all the necessary info needed. Wonder if he even has a license.

    Sucks but at least no one seriously hurt. I'm sure you can find a decent lawyer to handle this and at least teach him a lesson that way. Why wasnt he in school? And who drinks that much in the middle of a Monday? Was car even in his name or parents They are liable either way.

    If ur bags deployed I bet the cars totaled. What kinda suv I daily one this reason alone.

    Ahh must have skimmed that part, wonder if car was stolen and not reported? I would certainly make him pay, saw to many kids in high school get duis and only get a slight slap on the wrist. Supprised no drugs in the car too. Did he seem like he came from money or na?

    i dont know why everyone is worried about making sure you have info. the kid was arrested wasn't he? a police report was created. case closed. the only reason you need a lawyer is to sue for damages and medical expenses.

    glad youre okay. i feel bad for his parents for whats coming.

    If someone almost killed you and your wife you would think of that person a certain way. I expect to be returned whole and that means I want a replacement car with the same specs, mileage and top notch condition that my wrecked one was in. He is a juvenile. He will get his license suspended for one year. Big deal. He is not going to do jail or anything harsh for almost killing people. I will legally try to make this kid and his family pay fo any damages, time, physical and mental anguish.

    I really thought I was going to die when I saw him about to hit. I was expecting to be dead and was thinking "so this is what its like". I have never felt that before and it has really rattled me and my wife. Plus we never really thought about dying together. Always kind of thought it would be one by one. This has messed with my head a bit

    I'm sorry that I don't feel sorry for his parents. I actually blame them. They were on scene and I was not impressed to say the least. They bought him a car (admitted it to me), have not registered it yet, did not insure it, and the kid had a drivers permit only. They did not know what he was doing at 9PM on a SUNDAY. Kids parented a certain way act a certain way.

    The kid also got all shit*y with the cops. Lying to them and then challenging them "go ahead and pull some video and charge me". The cops did not appreciate that and I hope they turned off the camera in their car and took care of this kid like they used to do in the 80's with an "accidental fall".

    Wow, like everyone said the most important part of all this is you and your family are ok. Only been in one accident and it was one of the most frightening things to experience especially when time seems to slow down when you see what's about to happen coming.

    I normally would say that it's tough to default to blaming the parents but from how you described them, sounds like a case of the apple doesn't fall far from the tree unfortunately. Best of luck, keep us posted on how everything goes.

    Im glad you guys ok, and sad at the same time for your car....
    My was involved in a similar accident 5 years ago, she was t-boned in the intersection by a red-light runner illegal immigrant with no drivers license or insurance.
    Police didnt arrest her at the time, and when they wanted, she already left the country.

    Go after the kid AND his parents with everything you got! If you need a good lawyer, pm me.

    SH1T. You could be the safest driver and WHAM, someone hits you. Sorry bout your ordeal. Get you and your family back into perfect health and take them to court. Driving your baby out there is always a risk. My aunt was in a head on collision with a drunk driver in W. Va.. She was in a Chevy Blazer and her face got bruised up real bad like she went a few rounds with Mike Tyson.

    Glad to hear you and your wife are ok and were able to walk away from the accident.
    Go after the parents, the registered owner or lien holder of the car, his (parents)insurance company, the driver and everyone else that you can.
    Your insurance company is going to give you problems, the less you talk to them the better, do not make any statements to them.
    They will want to tape record your statements, do not give them anything. You might have to lawyer up on this one.
    I went through something very similar to your situation 16 years ago and it turned into a big pain in the ass by the time I got done with everthing.

    Just wanted to let you know that I am doing something about this. I fear this kid will harm someone else in the future if he is not taught a lesson. I contacted the local MADD chapter. They have a victim advocacy program. They interface with the district attorney to try and make sure prosecution is heavy and just. Hopefully I can work with the DA to get some justice. Even though the kid was 17, I have heard that since he was so reckless and so drunk, a lot of times they try them as adults. Wish me luck

    I have also realized that this messed me up psychologically. I really thought I was going to die and accepted that. Everyone knows they are going to die, but I fully went through the process of accepting it and that is a feeling I never have experienced. I really have not slept well since this happened. MADD said they have a new support group. I will attend. But I may feel a little guilty as I am sure people will be there that lost loved ones and here I am being somewhat of a puss not being able to deal with surviving this.

    Again, thanks to everyone on this thread for giving me a place I can vent and for being so supportive

    Glad to hear you're ok. I work in the insurance industry and as long as you have uninsured motorist coverage your insurance company should make you whole (monetarily) promptly. They will also be subrogating against the kids parents for all losses that they had to pay and many of the good insurance companies will have established relationships with lawyers to help you in this matter. As far as my knowledge in this arena, you should have a cut and dry case, his parents are vicariously liable for his actions being that he is a minor.

    Also, if you seek professional help for your mental anguish many insurance companies will reimburse you (within your limits) for that as well. I hope you and your wife get through this difficult time and are taken care of swiftly. If you have any questions on any of the insurance stuff, feel free to pm me. Good Luck!

    Hey man, sorry to hear about this and I am definitely glad both of you are ok. Looks like you have a lot covered but I would like to add:

    -Keep a pain journal for the both of you if anything hurts at ANY time since the accident. Also, see a doctor for both mentally and physically with regular visits if possible. Chiropractor is a must if injured.
    -Log down any stresses, work or relationship/intimate problems, and fear of driving. Everything can be used against them.
    -As long as your car will come out to be 40% you can total it. Just let the shop know you plan to total it and they usually make it a point to help. If it is your Audi, I can safely assume a head on collision its totaled. (see pic below)

    -Side note, look into buying your car back if the price is right after its totaled. You can make back a good portion of money just off of parting it out.

    Again, so happy to hear you 2 are unscathed.


    This was a head on collision at 15mph with a Toyota Corolla with her driving on the wrong side of the street. Car was totaled.
