Rear ended/Accident.. your guys thoughts.

So.... me and my father switched cars as he has a Q7 and I needed the room, I have an 10' A5.. and we where meeting to swap cars.
Get a call from him that he just got rear ended merging onto the thruway ( He is fine, thankfully ). Currently I am concerned on the cars state and how this will go down with insurance ( I'm thinking it might be classified as totaled). The lower left side of the car below the C pillar you can see the aluminum is crumpled up and the structure and alignment are off, and the chassis seems to be lopsided VERY slightly as indicated by how the trunk is sitting from my eyes. what are your guys thoughts?

Super unfortunate but I'm glad my father is okay, and the other schmuck on his phone that rear ended him.

I second the fact that your father is doing well. I'm sure things could have been worst giving the road conditions (looks like recent snow).

Now for the tremendous hassle you and your father have to experience. First off, I would get in touch with a REPUTABLE traffic attorney. I mean no disrespect when I say this, but without knowing your father's complete health history, he may be suffering from whiplash or other ailments associated with the MVA. With that said, you both need to be compensated properly (medical and property damages wise). DO NOT try to work with the other party's claims adjuster because they do not have your best interest in mind.

From the initial photo, I'll be honest...it's going to be very close in assuming a total loss. Most insurance carriers will not total the vehicle until it hits about 75% of the repair to FMV. Have the car towed to a shop you TRUST. Talk to them and tell them, you want it totaled and they'll work with you to assess the highest amount of damage.

If there is frame damage, I'd guess it will be totaled.

Sorry to hear that. The trunk being displaced may not be an indication of frame damage, as the impact could have merely bent brackets, pulled the quarter panel down, etc. That said, even if the car does sit straight, that looks to be a really costly repair, which might put you into "total" territory. Especially considering the car is a 2010 w/ 100k on the clock. That could be $12k+ pretty easily, depending on what the shop finds when they start pulling stuff apart.

Put sentimental value aside and hope it's totaled. If the vehicle is paid off, you could have a nice little down payment on a new one!

Call your insurer if not already and they'll take care of EVERYTHING. No need for you do do anything (towing to shop, etc).

My advice would be to make sure you are compensated for everything including medical bills. Also, my old car was totaled back in April by my own insurance company when the other party's insurance wanted to repair it even though how badly damaged it was so do not trust what the other insurance says.

I would get a second opinion. I don't think I'd want to drive a car that had been violated so viciously from behind. Would never drive the same again.

Glad to hear is not totaled but the car will never be the same. Wife's old car got banged up bad in the rear and the car never drove or felt the same. Best of luck.

Definitely get a second shop to look at it. Make sure they pull all the parts off to determine if there is any carriage damage.

If the car ends up being repairable, make sure you file a DV (diminished value) claim because with an accident on your CarFax, your car is now worth significantly less. And also make sure you father gets an aggressive traffic attorney. I hate to say it and mean no disrespect, but I think you're in for a headache. Accident's are never fun.

They are only looking at surface damage and saying it's not totaled. There is frame damage, and they must not have accounted for that
