Ok, First off I bought my 2012 Audi S4 at a dealership in Virginia.
The car had a lot of mods on it, but I was assured that they were performed at a Authorized Audi Shop and that the car had an existing factory warranty and that it also had Audicare. I asked a number of times about the warranty being intact because of the mods that were on the car. Same answer every time, yes full warranty because all the work was performed at a Authorized Audi Shop.
So I took them at their word, After all it was a very impressive dealership with a ton of high end cars, new and used. So I made the trip from Maine down to Virginia to trade my new truck in on the S4.
    Great experience so far....
Move ahead to now and I have a Transmission Malfunction, may continue to drive light popping up.
I brought the car to my local Audi Dealer to have the 35k mile service done under my Audi care.
Told them about the fault light, message that was coming on.
They did the 35k mile service under the Audicare free of charge. Started scanning my car to check on the fault code I was getting. They stopped diagnosis after about a half hour.
Charged me for the time and said because of extensive mods that it couldn't be fixed under warranty.
I'm like what??????? I bought the car with the mods already done and was told the factory warranty was indeed intact. They said no.
So what are my options, talk with the dealership where I bought it, trade the car in and move on, putting the car back to stock really isn't a option as I don't have any of the stock parts.
I really enjoy this car, but without the warranty I can't keep it. I don't have the cash to get the transmission fixed out of pocket. So where does this leave me?
    What would you do????????
    Opinions Please.

I can't knock you for believing what the dealer said but hopefully in the future you will not believe any dealers that tell you BS like that. Each dealership can deny to warranty something at their own discretion and good luck fighting it. I'd try to trade it in but if you're going to take a huge hit, I'd part it out and have it fixed via warranty OR use the $ from selling the mods to fix it and then sell it or trade it in.

Dealers will say anything to sell a car man. They may have even believed their own BS when they told you that. And #2 you never buy a modded DSG car. Yea I know some people on here have no issues but many do. DSG cars need to be stock OR reliably warrantied if they're going to be modded. Word of mouth is BS and IDK why people take word of mouth guarantees like that. I would have called prob 2-3 local dealerships to verify they would warranty the car modded like it was. Good luck !! Second this.

Sorry this happened to you. Posting up about buying a car with mods BEFORE you bought the car would have yielded us letting you know there is no such thing as an "audi authorized shop" when it comes to aftermarket parts. Your tune/parts could have been installed directly at an audi dealership and audi still does not extend their warranty to cover aftermarket parts or any repairs that they deem could be related to the aftermarket parts. If you want an intact warranty, you need to bring the car into them without aftermarket parts.

How can he return to stock and get it fixed if it was already flagged by that dealer? Or was it not TD1?

Thats a really good question. It appears you may or may not be successful in doing this. There are a couple forum members who fought the TD1 with AofA stating they had purchased the car already with mods. AofA required it be returned completely to stock, the vehicle be re-scanned and the removal of TD1 apparently worked. Others have been told to pretty much pound sand. If an engine/transmission replacement (10 to 20 grand) would put you in a financial situation that is a bit overwhelming I would really re-consider modding these cars. Its not likely the mods would even be the cause of such a failure, but AofA is within their rights to deny a powertrain claim on a car with powertraing mods. Sure you have a 99% chance that nothing ever goes wrong but you must also be prepared to pay if something does go wrong. I say this with empathy. It sucks to have a costly repair.

A local TTRS owner had this happen. The tech at the dealer told me the guy returned it to stock and got it repaired. Spent about 2K getting back to stock but saved the 12K bill.

If your car isnt scanned... Try posting on the classifieds section to see what oem parts you can source here.

As far as I know they stopped working on my car so I wouldn't be TD1 Thats why I paid out of pocket for the time they were diagnosing.
I wouldn't enjoy my car if I went back to stock.
So maybe if someone is fairly local and wants any of my mods in my signature I guess pm me with your offer and ill need your stock parts to put on my car. Then I'll trade it in I guess.
I also have a Enlaes Carbon Fiber rear diffuser on the way that will be up for sale.
So hit me up with some offers I guess..

Just keep in mind, your repair could be less than 2 grand if it just needs the mechatronic repair kit. I understand if selling it due to finding out you have no powertrain coverage though.

As an FYI, Stasis used to offer extended warranty coverage where Audi would leave off. It was a Dinan style warranty umbrella. While they were never an "authorized" audi tuner, they simply charged more money for mods than others and then extended a powertrain warranty to folks who bought them. They went out of business though.

Trailer it back to where you bought it and have them fix it. They warranteed the car, right? Seems the cheapest route to take.

Did you get that in writing? is there anything on any purchased documents that says it has a full warranty? If so I would be on the phone with the dealership that told you this and if they push further go to AOA and question their Authorized Dealers sales practices.

I agree about trailering it back to the dealership in VA. Unfortunately, StevenStark is right about many dealers. They can be lower than whale $hit when it comes to selling a car. I would to know which "Authorized Audi Shop" did the mods. Unfortunately the dealership can deny everything they told you.

The original work was done at StaSiS, I have the receipt for most of the mods in my signature from there.
I'm going to give the dealership where I bought the car from and see what they will do.
I keep going back and forth, I love the car and I need to stop thinking about taking all the mods off and selling it.
I won't be any happier if I let it go.
If I get the Mech unit replaced whats the chances it will go bad again in say the next 2 or 3 years?
And if the dealer won't stand behind it, what do you think it would cost to get it fixed right?
Thanks for everyone for putting up with my question's and the help you all have given me so far.

This is the best option. Every dealership is different, the service manager your dealing with is strict. I bought my car tuned and was told the warranty would be good at this dealership. The service manager reassured me that I would have no issues with the specific service team, but couldn't vouch for other service teams. I've had multiple things fixed or replaced under warranty with zero issues (factory and third party warranty), and my car has been TD1 since day 1. Either try another dealership in your surrounding area or take it to the one you bought it from.

I had mine replaced out of warranty at an Audi dealership. 3500 in parts plus ~1k in labor total IIRC. I suspect it will fail again at some point down the road but not in the next 4 years.

This. I am a big fan of getting Audi of America involved. If the dealer gave you anything in writing you have them. Tell them AoA would be very interested in seeing that text.

If you don't, you may be SOL.

You are pretty much out of luck if you have nothing in writing.

Lesson learned, never believe a word any salesman has to say when it comes to serious matters. What do you expect him to say, "nah you won't be covered with those modifications under Audi, but you still want the car right????!!"

Sad truth they'll tell you basically anything to move cars. After all his/her job is to take as much money from you as humanly possible without upsetting you.

you are going to have play the emotional card w/ aoa at this point and no one wants to take an emotional position as leverage w/ big business like Audi but they do want to keep loyal customers .. perhaps you can convince the right person - ehh i'm sorry man idk it's not a good situation. pretty much the only thing you need the warranty for is what you are experiencing now but quite frankly they should step up and replace / recall because it seems like it's just a matter of time for so many b8 owners and that's unacceptable in my opinion.

Yes, I went to my local tuning shop that is a Revo/ APR dealer.
They said I had old tunes, 91,93, and 100 octane files. Revo updated me with their current Stage 1+ files.

    Couple things...

Is the car CPO? If so, the original selling dealer certified it in its current condition and you have a good argument.

What you are told when purchasing a car has legal binding. If they told you that they would honor the warranty, they have to. The original receipts you have show the mods were on the car before you bought it, and they were aware of them.

That being said, I think a call to the dealer you purchased from should resolve things. If not I'd get lawyer.

Note: having the tune updated could cause an issue

he said vs they said -- what you sign contractually is legally binding not what the young go hard dealer pushing cars for his manager tells you verbally which has virtually zero legal binding. If i am wrong please feel free to correct me.

Actually specific to auto sales, there are laws that protect you as a car buyer on what the dealership tells you, written or not. In fact some documents you sign at delivery are designed to verify that you were NOT promised anything else, or told anything else. Check the laws of your state or consult a lawyer. There are some very specific consumer protection laws with regards to buying cars. First, check with the original dealer since they are the responsible party. If it is CPO, and the dealer certified your vehicle qualified as they delivered it, I believe as an agent of AoA you might have something there. But yeah, talk to an automotive specialized lawyer if it gets bad.

I wouldn't want to represent this case legally that much I know but if the state of virginia where he bought the car has these laws that you speak of then maybe he .. nah .. i still don't think he has a chance. If it was cpo then yes. .. might as well try the ecs mech repair kit sounds like a lot have had success.

Would it not be better to get the Audi repair kit? Or is it the same thing?

Has the OP spoken to the original dealer yet before purchasing repair kit? If not, stop wasting money and talk to them first.

But you added the DSG tune, and now you're having DSG-related problems.

A quick look at your post history reveals:

I got a Revo DSG tune a couple weeks ago to go with the REVO ECU tune I already had
Well I just did three top end pulls, 163mph all three times.
Ok I've tried the APR DSG tuning and now have the REVO DSG tuning.
I hate to say it, but even if your original dealer did warranty the car (as-is when it was sold), it's now long gone based on the above. You gotta pay to play.

Yes I tried the APR DSG tune, didn't work well with my original Revo tune that was in my car when I bought it.
So I had it removed and tried the Revo DSG tune, didn't work well either, delt with Revo and they thought it might be because my Revo ECU tunes might have been to old. They updated my ECU tunes for free. The DSG tune still wasn't working right so it was removed. No DSG tune in my car now.
That will change soon as I will be switching to APR for all the tuning over this winter.
APR will be working on a new tune for something that I hope will be a game changer.
Getting my car 100 percent first then, going to be working with them on a new option that APR has been wanting to do for a while.
Yes, you have to pay to play, agreed.

Thank you, I'm hoping for the best and if this does the trick I'll be happy.
It's a sweet car, and I'm not regretting the purchase. But that being said if I knew the warranty wasn't really intact like I was told I wouldn't have paid what I did.

Well, I should wait till The tuner and I talk and see if he wants this info really out.
I probably should not have even hinted about it, as its not a done deal yet.
APR and I still have much to talk about before we go forward, but they are very interested.

Was the dealer where you purchased the car an Audi dealer? Doesn't sound like it was based on your original post.

I think that the dealership where you bought the car should be contacted. Sounds like they misrepresented the car when you bought it to me. Explain to them that social media is a powerful thing, and give them the opportunity to pay for the repair of your car.

Check the paperwork when you signed for the car. My guess is that it states the vehicle is sold as-is and that if there's any remaining warranty that would be applicable under the standard T&C's of said original factory warranty.

In the end, if you bought a car that you knew was modded and should be TD1 then you should own up to that. The dealer selling the car is only responsible for selling you the car based on what they know to be true and again, I'd be willing to bet your paperwork says as is.

It may even be on the signed contract in a paragraph like this:

    As-Is Document Example

2018 Midnight Black Metallic AWD Infiniti Q50S Red Sport | Burger MS JB4 | 395awhp/430awtq
    2018 Ruby Red Metallic Lincoln MK-C Reserve | AWD 2.3l EcoBoost - Wife's

I just dug out my paperwork and from what I'm looking at I do see where you show the For "As Is"
But it looks like that is part of everone of their forms.
There is a place for a signature for acknowledging this and there is no signature by me or the dealrrship there.
Below this it says Mechanical Repair Agreement. Service Contract See Policy
So I'm going to call them on Monday To see what they have to say.

what's it say on your retail purchase agreement where the deal is broken down line by line? Chances are there's a note that says if marked "as is" in the warranty statement then the vehicle is sold as is with no warranty as to mechanical condition. Further details will likely be in the fine print on the reverse side of said agreement.

Not sure that would make sense. If I worked in their F&I dept. I would ask the person calling if they had a copy of your paperwork and are an attorney. If they answer no to either or both then why would they be calling? There's no proof yet that they did misrepresent anything.

Yeah, not sure the angry mob approach is the one you wanna go for right now. A friendly call explaining the situation and plea for help might just make it all go away. You catch more flies with honey and sometimes all you need to do is ask. If you come at them guns blazing it might turn them off and your battle would just get more difficult.
