    Today, VW met Judge Breyer's deadline for a settlement to be agreed to. Judge Breyer has given VW until June 21, 2016 to put together the final details of the agreement and include the 3.0L TDI into the settlement, which it was not today. (Here are more details on the settlement - Click Here)

    Here are some details of the settlement disclosed during today's court hearing:

    The judge said the settlement includes VW's offer to buyback 482,000 2.0-liter vehicles, fix them if regulators agree on that step after further testing, or cancel outstanding leases.

    The U.S. settlement will include an environmental remediation fund to address excess emissions, and additional "substantial compensation" to owners to sell back or have their vehicles fixed, Breyer said. The size of the fund and the amount of the compensation to owners were not disclosed.
    Volkswagen spokeswoman Jeannine Ginivan said customers do not need to take any action immediately. Based on the court schedule outlined on Thursday, the earliest buybacks would begin is likely in July.
    Reuters reported that owners will get around two years to decide whether to sell their vehicles back including the 2009-2015 diesel Jetta and will be offered the estimated value of the vehicles from September 2015, before the scandal erupted, along with an unspecified premium.
    Breyer did not disclose the amount of money involved, and ordered lawyers for all parties not to disclose details until they were final. He said there is "definite momentum" toward a final resolution.

    The judge set the June 21 deadline for VW and the other parties to nail down the final details before the agreement faces a public comment period. It would need final judicial approval before taking effect.
    U.S. District Judge Charles Breyer, who outlined the agreement during a hearing in San Francisco, said he expects the issues of Justice Department fines and resolving the 3.0 liter engines will be addressed "expeditiously."

    At today's US Court "status conference" Judge Breyer stated that "substantial progress" has been made toward a settlement for the 2.0L TDIs. 3.0L TDIs are still having "engineering studies and testing" being performed. Unfortunately, there aren't any further details pertaining to the 3.0L TDIs, at this time.

    To summarize, the parties are on track to publicly file the proposed settlements on June 21st.

    As previously announced, the Court will hold a preliminary approval hearing of the consumer class-action settlement on July 26 at 8:00 a.m.

    In the meantime, the Court will also hold a further status conference at 8:00 a.m. on June 30th.

    US Courts extended VW's Settlement Deadline of June 21st to June 28th, 2016 @ 12pm. It is believed that this settlement deadline is solely for 2.0L TDIs and 3.0L TDIs are expected to be resolved at a "later date', which is currently unknown.

    EPA accuses Volkswagen, Audi of evading emission laws



    The Environmental Protection Agency on Friday accused Volkswagen of installing software on 482,000 diesel cars in the U.S. to evade federal emission regulations, potentially exposing people to harmful pollutants.

    The German automaker adopted what the EPA called a "defeat device" to trick U.S. regulators into believing that its cars met Clean Air Act standards, the federal agency said in a statement.

    The agency said the diesel cars that violated federal standard were the 2009-14 Volkswagen Jetta, Beetle and Golf, the 2014-15 Volkswagen Passat, and the 2009-15 Audi A3.

    Those cars emitted nitrogen oxides, which can exacerbate respiratory conditions such as asthma, at up to 40 times the standard level, the EPA said.

    Volkswagen admitted to investigators that it had installed the defeat device, the EPA said.

    Affected diesel models include the 2009-15 Volkswagen Jetta, 2009–15 Beetle, 2009–15 Golf, 2014-15 Passat and 2009-15 Audi A3. And only seems to be the 4-cyl models.

    I think the EPA is going to scrutinize the complete TDI lineup now, so I wouldn't be surprised if we see more models added in the near future. Also this fine will be a huge blow to VW/AUDI and I wonder if that will deter them from bringing more TDI models to the USA.

    The table(attached to the EPA document) shows only 2.0L diesel engines, but it does state that the EPA's investigation is ongoing and they may find more violations. So, more vehicles could eventually be added to this.

    The EPA’s investigation into this matter is continuing. The above table represents specific violations that the EPA believes, at this point, are sufficiently supported by evidence to warrant the allegations in the NOV. The EPA may find additional violations as the investigation continues.
    Remember it took them a long time, several years, to discover and confirm the algorithm which disabled the emission equipment unless the vehicle was being tested for the current list of violating vehicles. So I wouldn't be surprised to see that list of vehicles grow over the next several months.

    Exactly and don't forget that California will also be suing or fining them seperately.


    If the 3.0L TDI gets swept into this, I will not be happy if they have to detune it for emissions. I'm sure a class action lawsuit will start soon.

    Sounds like the VW CEO is throwing his engineers under the bus with this statement. It's also interesting to see that VW has stopped sales of TDIs in the USA, which were listed by the EPA. In my opinion that doesn't look like a good sign.

    Volkswagen's CEO apologized for customers' "broken trust" on Sunday after the company was accused last week of defrauding environmental regulators.

    Martin Winterkorn issued a statement that stopped short of admitting guilt, but said he was "deeply sorry that we have broken the trust of our customers and the public."

    "We do not and will not tolerate violations of any kind of our internal rules or of the law," he added.
    The company also said it had stopped selling the vehicles at issue.

    The U.S. Environmental Protection Agency was tipped off by testing done by the California Air Resources Board. The federal and state regulators said Friday that the German company cheated on its emissions standard compliance by programming some diesel-fueled cars to turn on emission controls only when being tested. The software is installed in nearly 500,000 Volkswagen Group (VLKAY) cars on U.S. roads, including some of its luxury-brand Audi cars, the EPA said.

    Winterkorn said the company will "cooperate fully" with the EPA investigation and has ordered "an external investigation of this matter."

    It's unclear whether that investigation will include cars sold outside the U.S. A company spokesperson was not immediately available for comment.

    The EPA has ordered the company to recall the affected cars to address the issue. The models include VW Jetta, the Beetle and the Golf from model years 2009 through 2015, the Passat from 2014-2015 as well as the Audi A3, model years 2009-2015. Only diesel versions are involved.

    I realize that it's more about the fact that they lied and cheated, but the system is still broken.

    That's not legal in many states either, but this issue isn't about aftermarket modifications. Instead it is about selling a vehicle which never met the emissions standards at all and lying to the public with false advertising to encourage them to purchase a product which they knew wouldn't comply with current emissions standards with its currents specs. Basically, it's about VW/Audi committing FRAUD on a massive scale.

    That's a good point. Surely, VW/Audi wouldn't do something so brazen without first dipping its toe into the water with other fraudulent acts prior to this grand one. It must of tested the water before in order to think it could get away with this.

    Also, considering the size of this fine, VW/Audi is going to have to be creative on how to recoup that money and they may cut quality in order to do so.

    I agree completely, seeing as I purchased a Q5 for my wife just this Saturday the timing on this is a bit disheartening, but I am optimistic that it will stay specific to the non-Adblue I-4 2.0 models and not expand out to the V6.
    Time will tell.

    I have "modified" my ecu to allow brake boosting on my RS6s, I have also increased boost, fueling and timing.

    My poor 12yr old Audi's run 0-60 in 3.7sec and trap in the mid 115s.

    Whats a few HEX bits changed between friends? Is the EPA looking for you too?

    If the emissions ******y ends up being a problem for the Q5 TDI as well, they are likely to apply an update to the car that changes the performance, right? I bought it because of the performance when I test drove it, not the lesser performance that will apply after the update...

    If I were you I would tell the dealership to put it in writing that if the Q5 TDI is affected that they will be responsible for a full buyback at the exact cost paid. If they try to wiggle out of doing that then you can walk away, but remember you may lose your down payment. It isn't a odd request considering that VW/Audi has eroded all trust to the consumer by attempting to cheat the system.

    I read an article that was posing a solution to illegal vehicles which included the retrofitting of a Selective Catalytic Reduction System for the 2.0T, which in parts alone was $2,500 not including the labor to be performed. Even with the SCR system it still was illegal - NO levels still too high. My question is why wouldn't they just change the software rather than attempt to retro fit something to get it to comply? I can't imagine how much of a pain it would be to have to take your vehicle in and try and schedule it for something that could take upwards of half the day to complete on one vehicle. Dealers would be slammed. If it was just as simple as a software update it would take no time.

    Volkswagen chief's swift resignation highlights exploding global scandal


    The Volkswagen emissions cheating investigation has claimed the chief executive’s job in less than a week, another sign that the exploding scandal could eclipse even the troubles of automakers enmeshed in crackdowns on safety defects.

    Volkswagen Chief Executive Martin Winterkorn quit on Wednesday, saying he was “ not aware” of any wrongdoing on his part, but “stunned that misconduct on such a scale was possible in the Volkswagen Group."

    The wrongdoing stands out from other auto scandals for its boldness – years of cheating and lying to hide pollution from diesel cars – and for clarity of the company’s guilt, from the moment the investigation became public on Friday.

    Once the billion-dollar fines and lawsuits and recall expenses are tallied, it may also eclipse other scandals in its damage to the brand and its bottom line, said Jack R. Nerad, executive editorial director and executive market analyst for Kelley Blue Book.

    “The Volkswagen scandal has escalated far beyond the realm of recent safety recall issues that have affected other companies,” he said. “With VW's market capitalization down by a third and rumors of criminal investigations popping up on at least two continents … The VW Board obviously feels compelled to do some quick triage to stem the bleeding.”

    Mary Barra of General Motors, by contrast, weathered the investigation into defective ignition switches with frequent apologies, a few firings and repeated pledges to inject accountability into GM's bureaucratic culture. Akio Toyoda, at Toyota Motor Co., navigated that company’s record recalls and fines related to a cover-up of alleged, unintended acceleration incidents.

    But the storm now facing VW and Winkerkorn demanded a swift change at the top, analysts said.

    Neither regulators nor Volkswagen have yet named those who designed, installed and approved the cheating software, but Winterkorn's resignation marks the first casualty -- and likely not the last.

    “What Volkswagen did was heinous – borderline criminal, and certainly immoral – and someone has to pay for that,” said Howard Bragman, founder and chairman of the PR company Fifteen Minutes. “The CEO was left with no choice but to resign.”

    Bragman – who grew up in Flint, Mich., in the shadow of car giant General Motors – said anything less than the chief executive’s resignation would not have been appropriate or effective in addressing the scandal.

    “The level of person that has to leave is directly proportional to the egregiousness of the act,” Bragman said.

    The fact that the deception had gone on for years – dating to 2009 model cars – suggests either that Winterkorn knew about it and approved it, or was negligent in failing to discover and stop it, said Karl Brauer, senior analyst for Kelley Blue Book.

    “Either situation reflects poorly on Winterkorn and his leadership skills, and given the tragic impact this scandal will have on VW, his resignation wasn’t just likely, but necessary,” he said.

    In a statement Wednesday, Winterkorn said that, as chief executive during the entire period that the cheating occured, he accepts responsibility for the "irregularities that have been found in diesel engines."

    "Volkswagen needs a fresh start -- also in terms of personnel,” he said. “I am clearing the way for this fresh start with my resignation."

    The cheating software, called a “defeat device,” was installed in 11 million vehicles worldwide and threatens to destroy the credibility and market value of a global behemoth that was already showing signs of instability. On Friday, federal and state regulators said the German automaker used software in 482,000 of its diesel vehicles since the 2009 model year to cheat on U.S. emissions tests.

    Volkswagen confirmed – under pressure from the EPA and California regulators – that it installed software to manipulate test results in diesel versions of five U.S. models over seven years: the Jetta (2009-15), Beetle (2009-15), Audi A3 (2009-15), Golf (2009-15) and Passat (2012-15).

    The software employed an algorithm that automatically detects when the vehicle is undergoing pollution tests and changes how the engine performs. The algorithm sensed whether the car is in a testing environment by analyzing a variety of data -- steering position, speed, duration of engine operation and barometric pressure.

    Away from the laboratory, in everyday driving, the cars emit up to 40 times the legally allowed amount of nitrogen oxide, regulators said.

    Marketing the cars as “clean diesels” – a sporty alternative to boring hybrids – the automaker dominated the niche market for diesels, with more than half of U.S. market share.
    Whatever profits those sales generated, the cheating will end up costing VW far more.

    Facing as much as $18 billion in U.S. fines alone -- and liable for fines and punishments in other countries -- Volkswagen said it would also set aside $7.2 billion to cover the cost of recalls and “other efforts to win back the trust of our customers.”
