I think the cali statute reads similar to EPA statute as well, meaning that nationwide you cannot put an older motor in a car newer than the motor.
As for the swap being uncommon, it doesn't make much sense because you could just buy a 97 1.8t. Sounds like OP had a good opportunity though and got it done cheap, so why not?
As far as I know, cali emissions and doing a swap. You just have to swap everything over that is required by the state. Other reasons I just did a swap instead of buying another car.
- I put a lot of time and effort into doing other things to the car interior/exterior/suspension
- V6 transmissions have taller gears from what I've heard. I know I can hit 130mph in 4th.
- Laser Red. Not to many Laser Red B5 Audi's here in colorado that I've seen.
- I love my car, loved it since I've owned it and I know her like the back of my hand.

Everything was a direct swap over. Removed the old engine wiring harness, and put the 1.8 one in. Only things I had to "fabricate" was the fuel lines needed to be extended going to the engine and I had to reuse/bend to fit the 12v power steering line. I could have pulled them off of the passat fuel lines from gas tank to engine, and the rack and pinion assembly, but i didn't want to have to deal with that much more work to do something that was easy enough to make.
