Oops, just saw from your original post the "officer" said no illegality...
If your insurance company is anything like mine, they take the path of least resistance. If they can get you to pay the deductible and also 'find no one else at fault', they'll have you pay the full amount (in the future by jacking up your rates next time around). It's cheaper (for them) than finding and harassing the 'other party' to pay up.
As soon as you get a lawyer involved, they'll start looking around for other pockets to pick (University?). At any rate, make sure you (or your lawyer) makes it clear that accident is not your fault, try to avoid paying the deductible and getting the accident on your insurance company's database as 'your fault' which will up your rates in the future no matter which insurance company you use as they share accident info with all their competitors.
If you don't have insurance to cover the damage, i guess you need to find out the cost of repair and the cost of lawyer, and see if the lawyer thinks he/she can get repair money+laywerfee out of the responsible party/parties. I think in most small claims courts, you can't include the lawyer fees in the damages award, so maybe the only way to avoid paying the lawyer is to hire one that can get things settled out of court.
