I would have followed, got the licence plate number and given it to the owner of the car that was damaged.

That is what I would like to happen should that ever happen to me...

Not necessarily... stolen plates, stolen car, etc. Also the driver has to be ID'ed to be charged. If he was drunk it would be worth it to run too. If you make it home, no more impaired... one of the holes in the law.

Actually I think the police can still charge you if there is sufficient evidence you had operated a motor vehicle within the past 3 hours of your being found impaired (i.e. even if you make it to your house?)

They have three hours to get you to provide a breath sample.... If you made it home unseen police would need you to admit you were driving, admit that you drank prior to driving and admit that you did not drink after getting home.

You could always say you pounded a 20oz of vodka after you got home and that you were ust trying to calm your shakes from the accident. Happens all the time...

They still have to say unequivocally that they saw the driver... best case scenario would be a fail to report accident charge if the police could get to the car before its fixed.
