Thumbs down OMFG Are you f'in kidding me!!!

Guest-only advertisement. Register or Log In now!
So you guys remember that last post by me about my $450 ticket for a 105 in a 55?

Right after that I go to Reno for a few weeks... I couldnt make the court date so I called in and told them I cant come in... They gave me a 2 weeks extension...

Now I come back, and I see a "you missed a letter" bullshit on my door. I go to the post office, and guess what it is. The same ticket, but now $1000

    Here's the letter ::

"RE Oregon Uniform Traffic Citation and Complaint: XXXXXX

Citation number XXXXXX replaces the original citation that was issued on 121108. THe new citation was issued on 121208. The bail amount was incorrectly listed on the original citation and has been corrected on the enclosed citation.

Thank you for your cooperation in this matter. If you need any further information regarding this citation, you may contact the Springfield Municipal Court at .....

    Sincerely,

    Jerry D. Smith
    Chief of Police

    ...
    ..."

So can they do that? Can they make a mistake like that and get away with it? It wasnt wreckless driving or anything... Just speeding.

The cop paced me from way behind too! And I know for a fact I didnt go over a 100.

Also, "The bail amount was incorrectly listed..."
Is the "base fine" the bail amount? Or did they fuck up on that too?

    FUCK!

Ohh and now its a different court (central lane justice), which is not the one I called. Does that mean I have a warrant out for me now too?

If I were you, I would pay a lawyer 500 bucks to go with you. Maybe if you are lucky he can make the points dissappear and get the ticket reduced. But if you go in there alone, your probably gonna get screwed big time.

Yes he got me for 105 in Oregon. I however was no doing that much. I was scared to go over 100 there, because I know how fucked people get in Oregon for doing 3 digits.

I just talked to my attorney, and hes like "well you can pay me $750 to do your case, but either way, you are FUCKED! The judge will not take take your side on this one... "

Re: OMFG Are you f'in kidding me!!!

So you got your extension, but the original citation was for the incorrect amount, so they sent you a new citation with the "correct" amount and now your pissed, which is understandable.

    You need to:
A.) show up in court/pay your citation
B.) pay someone to represent you and take care of the citation, reduce fines, reduce points, etc.

IMHO, since the Bail amount is above $1K I'd get adequate representation. There really is nothing to argue in your case from what you've stated, but a reduced fine and knocking down points is well worth the attorney fee.

could be more than just one citation, which would justify the change in the bail amount.

I don't know what your attorney's fee are, but it should be no more than 2 billable hours of his time. Any criminal defense attorney will do, preferrably one is an active motor enthusiast or who knows the judges.

Re: OMFG Are you f'in kidding me!!!

i actually just payed a ticket today. 64 in a 45 (19 over, 20 over is wreckless where i got the citation). he gave me a brake since i just took classes for another ticket i got 2 months prior. he only gave me a ticket for a generic moving violation, rather than a speeding ticket. he saved me 60 bucks ($141) and 1 pt. the ticket was due on the 22nd of last month, but it was only a 19 dollar late fee, so total was $160.

i would try contacting the police department or traffic court and plead your case, that you got an extension and the fine/cost shouldnt go up. see if they may be able to change or reduce it to what it was. just be nice on the phone (at first).

edit: just re-read the op and saw that the bail amount was "incorrect."
in that case just do what belinko said and get proper representation.

Re: OMFG Are you f'in kidding me!!!

from things ive heard from friends who know cops or have had experiences with cops or whos dads are cops...ive heard that if the cop makes one mistake when writing the ticket that the ticket is now considered "invalid". for example...if its 12pm and sunny and the cop writes down on the ticket it that its 12am and raining...then the ticket would become invalid and dismissed in court.

i know people that have had the oppertunity to take advantage of such situations and have been successful with it. if the cop gave you a ticket for $450 and you have the original ticket that says that the fine is $450 and then the next day changed the fine to $1000 without notifying you, then you can most likey fight that and either get the ticket dropped or at least reduced.

2 things i would do if i were you:
    1. invest in a good radar detector...if you spend $400 on a radar detector it can reduce your chaces of being stupid and getting a $450 or $1000 speeding ticket
    2. get a PBA card...it will save your ass

also the ticket was written by the chief of police...so i wish you the best of luck in getting anything dropped or changed...sorry bro...go to court...if you cant get anything changed then i hope you can afford the ticket.

    good luck!

Thats what I thought!!! Then I called an traffic attorney here in town, and he says they can do that... WTF? If they write down an incorrect address or time/date etc, the ticket can be thrown out, but if its the base fine, it cant?!!

God Im gonna get raped up the as with this one. I dont even wanna see my new insurance cost...

this is...in no way true. alot of people think this is the case, but in fact there are only about 3 things on the ticket that actually have to be correct.

how fast were you actually going?

belinko, i dont know that he needs a criminal lawyer, he did not commit a crime.

Re: OMFG Are you f'in kidding me!!!

I checked out Attorneys... Its like $750 and he says he knows the judges here... If anything, it would only get it lowered a bit.

I was maybe 95 tops. He said (also shown on the ticket) that he paced me at 105, even though he was at least a quarter mile behind me.

Re: OMFG Are you f'in kidding me!!!

You know, when I was working at the law firm we would search forums, myspace, blogs etc,. to catch these claimants in a lie.

Lets just say your basically admitting guilt in this forum. Pray that the judge or cop is trolling this forum collecting evidence.

Your admitting that you were speeding but you defintely werent going over 100mph.
Speed limit is 55 but your stating you went no more than 95.

I dont know oregan laws but 40 over is definitely considered reckless driving.

    Just remember this line

" anything you say ( on this forum ) can be used against you"

I know because I've made cases this way.

Honestly, consult with a lawyer just to see if you can pay the fine without being assesed any points.

Re: OMFG Are you f'in kidding me!!!

    OK let's review.
You state that you were doing 100+ just out of town, 90+ in town and in your OP you said "I got pulled over by 7 cop cars and a K-9 unit".
If you've just priced yourself off the road I say "GREAT" Oregon will be a safer place.

Just be glad you didn't spend a night in jail. The fact is that you got caught going well over the speed limit, so you should expect to pay out the ass for it.

BTW the court sets the price of your ticket not the cop, the cop just puts a cost of what you should expect to pay but it can always be more or less.

haha, i hope you pay 10k annually for insurance, or better yet are considered high risk so you cant be insured.

you admit to doing 100+ 'out of town' and you brought it down to a crawl at 95 in town...what exactly is your problem with what is happenning to you?

Hell no! Because the dipshit will still be driving around, hit me and paralyze my family and I, total my car and I will be shit out of luck because he "wasn't insured." A better deal would be for him to go to jail and GIITB... He won't think about speeding ever again without sitting in a corner and crying for hours on end, because of "Buba"....

Re: OMFG Are you f'in kidding me!!!

Wow, this thread definitely started getting on a different track. ^^^

Anyway, we have all done it, speeding that is. True, some people have done it way worse, but I hardly doubt there is somebody on this forum who has never broken the speed limit, so give the guy a break.

Just be glad it didn't happen in Virginia. I don't think I would get a lawyer in this situation. You will pay him just under $1000.00 and it is simply luck if it gets reduced. It really depends on the judge, not the lawyer.

Most of the times in traffic court the lawyer doesn't even get to talk too much. That's here in Virginia at least.

Regardless, be careful. I would take one of those courses on driving before court, and be ready to have that license taken away. e happy if you don't go to jail for a few nights. Community service may be the next step for you.

Re: OMFG Are you f'in kidding me!!!

Thanks you guys for making me feel so much shittier.

I know I was stupid and I was speeding, but look. It was just when I got the car. I got new 18" BBS RC, and a MTM chip. It was in the middle of the night with barely any cars around, and I just wanted to see how the car performs. I probably passed like 2-3 cars total throughout this whole thing, and I slowed down for each one.

I know I fucked up and I know it was dangerous, but first of all, I would never do that on the streets or around cars, and Im pretty sure after this I wont be doing it at all anywhere...

105 in a 55 is reckless driving in most states. I say just show up to court and plead your case in an honest way without getting defensive. The judge might just reduce the fine.
