while parked. and i was in my car. guy comes flying down a street in an evo, lost control, and slammed into 3 parked cars, mine being the one on the end. my driver side door like exploded and took most of the damage. i also have damage to the back driver side door and passenger front door. on the 26th im getting the police report sent 2 insurance so i can get the estimator to my house. can anyone say-$$$$$$.. i'll post a few pics tommorow. my driver side window is stuck down too in this cold rainy weather. my friend did a blue book on my car and its worth like $5k... think i'll see somewhere near that?

i would have just sat on top of the guy punching him until the cops got there. your lucky as hell it looks like you only need one new door. the damage looks high enough to have cleared the lower frame. obviously buy one new from a dealer since the guy will be footing the bill. and make him pay to have any scratches you may have fixed. drunk driving = fail.

it depends. im going through insurance right now with my car from being keyed. they are sending an adjuster to my work as that is where ill be when he is coming out.

if you goto one of the bodyshops that is recommended by your insurance, then no. you drop it off its fixed, out of your hands, life goes. but they do it as cheaply as possible. i have 2 dings in a panel that isnt from someone else, 2 recommended places wont fix it unless i pay for it.. another place fixes those dings because they are already working that panel, why spray paint over a ding when its right where you have to work to fix the scratch..

id goto a recommended place, get a quote, go elsewhere, get a quote. see what work you'll get done for the money. some places only panel paint, if it doesnt match you can bitch but you should of asked before hand.. some will blend.

call your insurance agent, they will be able to tell you what to do. once you have the police report, take alot of pictures of the damage before you do anything. then file a report with his insurance co. they will send out their adjuster to look at it probably. then you submit an estimate for repair to them and they pay for it.

since its not your insurance policy thats going to be paying, its his- you can have the car repaired wherever you want. you dont have to agree to have it repaired at his insurance companies approved shops. obviously get estimates from a few places, and you dont have to settle for the lowest bidder .

its basicly up to you how you want it fixed (within some reason). its not your insurance policy the money will be coming from so they really dont have any leverage to tell you what to do, and they cant refuse to pay for it. if you wanted to you can argue that your car is 10 years old and any repaint of one pannel will make the color uneven due to the faded OEM paint so the whole car needs to be resprayed for it to be even.

Fact is that if the car can be driven the insurance company will ask for it to be taken to a local shop that they deal with.

They will ask you where do you want to take it then they will say they have certified shops they deal with. You are free to take it there, no questions, works done you leave. If you take it to an independant, your insurance company sends an adjuster out, he tells you what you are getting, writes you the check if you own it, if you have a lien they hold your check till you find a place, put it in their and your name.

I know from experience, I'm in the middle of this now. Adjuster coming out monday.

Usually you need to take it to a shop before any work is performed IF you have a dispute on the write up from the adjuster. If it is American family they will come to you, Progressive had me come to them. It just depends on the company.

I see you live in NJ, IF you go through your own insurance and don't go by 3rd party(meaning handle it yourself) you will most likely have to pay your deductible, whatever yours is.. When I had state farm and got side swiped my insurance wanted my $500 deductible for them to gimme the check then when they got the check in from the other insurance (liberty mutual) I would get my $500 back in about a month or 2 she said. I said F that and called liberty mutual myself to make the claim and handled it myself, got the check mailed to my house in about 4 days after taking it to my body shop for the estimate and faxing it to libery mutual.

Hey I dunno where you are in NJ but I work at a shop in south Jersey and we do some of the best work in the tri-state area if you are looking for a good place to get it repaired...just throwing that out there...anyways good luck. O yeah and regardless what insurance you go through you can take the car anywhere you want and get it repaired, they cant tell you where you are going to get it repaired no matter what.

Since your car was legally parked he is 100 percent at fault. I would contact both his insurance company and yours, talk to them both, see what they say. His insurance company may be responsible for paying the whole tab. I was driving a chevy cavalier in an ice storm, a driver in a jeep spun out destroyed the whole front end of my car. I got the police report and called his insurance company. They sent an adjuster out and cut me a check for the damages. I had no fault insurance too.

Different state have different laws find out what they are for your state. You probably can get it paid for without making a claim on yours.

sorry to thread jack but i am in a similar situation as well. about 2 weeks ago, my wife and I, along with my 11mo old son were driving to Gainesville FL from tampa. we were slowing down for an intersection and the lady behind us dozed off and rear-ended us. we pull into the nearest store (happened to be jack-shack) and she parks behind me. she then rear ends me again, because the car is still in friggin "D". i jump out of mine, and open her door, putting it in park. she spends 5 minutes trying to open her door, before my wife opens it for her and she gets out. this lady seemed jacked up on something since she couldnt stand at all, and dropped her keys 3 times, which i placed on her hood. she did not belong on the road, especially since before the accident she drifted into oncoming traffic and swerved back in behind us. anyway, damage was minor so i was gonna let it ride, but then when i saw how bad she was, we called the cops so she wouldnt kill someone. FHP came out after 40 min (the lady was passed out) and i told him the story and that i wanted a police report (twice). he insisted on giving me a drivers information exchange form and stated that estimated damage for my car was only 200 dollars. he also did not cite her as it seemed to be a medical condition and not from alcohol or drugs even though she had two big ass bottles of medication on the passenger seat. as i understand it, FL is a no-fault state. i have not yet followed up with my or her insurance, nor have i requested a police report, in fear of my insurance rates skyrocketing even though it was her fault. my friend told me i could sue her but it seems like too much of a hassle. anyone have experience with a situation like this, or could give some insight? again really sorry about the threadjack, this post just reminded me how pissed off i am about the whole situation. thanks.

to the OP: since your car was parked, the moving violation rests 100% on the guy that slammed into you. your insurance should have nothing to do with it and you should not have to pay any deductable because it really had nothing to do with you. his insurance should cover every dime of it, and you should personaly make sure of this.

@ B5A4Kevin: the officer should have done more to make sure the lady was fit to drive. it sounds like not much was damaged but you were more concerned she didnt kill anyone else. since the officer refused to do anything about it at the time theres not much you can do besides go after her in civil court, and thats probably going to be more hassle then its worth. you can get a new bumper out of her insurance if you would like but thats about the only recourse i can see. because the officer let her go back on the roads any lawyer is going to argue the officer thought she was fit to drive. maybe he hadnt seen her stumbling around and dropping her pills all over. sorry to hear about that.
