Seriously....Need Help

im sorry audiziners that i keep posting this crap up.
I really dont like to post things unless i have to....this is important.

Here is the story with details. I was going to lunch with my friend. We are doing togo at ph changs. The Lime Green trail is our walking paths. So i get to my car (blue) and i back up and go. She walks up to her car and backs up and goes. By the time she backed up im already in the lane across from her.

I stop at the corner and yield. Then out of no where she comes by and hits me right on the drivers side.

The parking lot was packed and there was a tree on that corner.
I did yield and then took the turn.

Now this happened on october 16th. A week after the accident...she got a new car...
Insurance claims took care of the faults and everything. Insurance claims people settled for 60% my fault and 40% hers. It was my fault for fail to yield (psh...) and her fault for speeding. I was ok with that... we just decided to pay for our own damages.

There were no tread marks on that street. There was also no sign of her stopping. Shes a terrible driver and cant keep her eyes on the road.
She drives with her iphone in hand most of the times.
i know,....because i was in her car a couple of times.
That is the story 2 months ago...


Now, i just got out of finals and checked my phone.
Insurance calls and says that her insurance wants to blame 100% my fault.
So they need to redue the claim.
what the fudge?!

ok...so she does go to the same school as me.
Shes spoiled as hell...and...got a new car a week after that.
I was told that parents and my friends know shes terrible at driving.
We are kind of fighting, but its like nothing big...just she makes it a big deal.
Its just stupid drama...

Now after two months they want to bring this up again?

i was told i should get a insurance attorney.

What is she getting out of this?
She already got a new car and i still dont have mine back from the shop yet.



There is no way she can do that much damage in a parking lot.
She was speeding.
She didnt see me.
She totalled her infiniti and my car is with 7000 worth of damage...it keeps going up cause they keep finding more problems...

List of things left to do on my car....
A-pillar
door frame
and reassemble/ paint

what should i do?
get an attorney?
settle it ?

oh and to add that if i do take an attorney on this,i hit my head on the window when my car was hit. I had a lump for a week
It was a pretty bad lump/ bruise.
She walked away from the accident without a scratch.

People say she ment to hit me on purpose and to back that up...shes not letting this go at 60 / 40.
So now they are bringing it up again and wants 100 my fault.

I know you were probably trying to jump into #($&@ with this girl. But that doesn't mean you give her a pass.

60/40 was pretty good deal to start with.
Failing to yield is always going to be your fault, no matter what judge you end up standing in front of. Unless there were extenuating circumstances, much of what you said isn't going to be considered in mitigation.

The only thing you can probably tap her for is her insurance company reneging on the initial agreement.

At this point, it's out of your hands. You need an attorney.

fight it... 100% ur fault fucks u up in the long run anyway, u need pictures.. of the accident.. bruises/stuff... etc etc.. build a case.. get a lawyer who specializes in automotive claims.. goodluck.. Oh. and hire a few big sugamamas to rough her up, maybe she'll change her mind.

Not sure what you want to know from us but sorry about this. To me, it seems that it should be less your fault because if she was speeding and came around that corner, you could have pulled out and not have even seen her. I would say 50/50 if anything...

It seems to me like you just didn't see her coming... even if she was speeding i don't think she could have made the corner and hit you right after you had looked...but idk...i wasnt there but i think that is what the judge would say. If you're driving and someone pulls out in front of you to cause an accident it's your fault because you are supposed to have your car under control at all times. Her front hits your your door - seems like the same situation to me.

Either her parents decided to change the deal or the insurance company did because they are cheap. Don't back down, I think you got this. Dont' worry about her friendship, you won't even see her again after school so who cares. If you didn't sign anything to admit fault then work with your insurance company to get it settled. They have their own lawyers don't they?

IMO, your insurance should pay to fix your car so you can get up and running again and they battle it out between each other to figure out who pays what.

no worries about that.
i dont value our friendship.
im paying the deductable out of my own pocket.
all the money i saved for mods is going towards fixing my car...
i havent paid for it yet.

hmm...how can i explain the time?

She went into the restaurant to get the food. She arrived there first and when she walked out, i just pulled in. I get out of the car and take the food and walk back to my car. As i am setting the food in my trunk, she starts walking towards her car. When she gets to her car, i should be already at the corner about to go down the next aisle of cars. When im going down the lanes, shes pulling out. When i get to the end of the lane, shes at the end of hers also. so i wouldnt even see her car. She pulled out like a second before i did. Floored it and just rammed my car. So the time it takes her to walk to her car is the time it takes me to back out and drive down my lane and take a left onto the other lane. the timing was right because when i get in my car, i start it, get my ipod on a song, then back out and check. I was not speeding or racing my way out. It is stupid to be doing that in a packed parking lot.

a little update

I just spoke to my insurance. They stand behind me on this is NOT all my fault. I did a couple of sworn statements with my representative and they are going to build a case.

I will probably get word on how this went on Feb 10th...

So...while waiting on that...
all i want for xmas is my car back....
got a lot of mods and ideas in mind...but need the car first...

In case you don't know, I own a chinese restaurant. And to further educate u, there is no gray chicken. And I don't know what ass tastes like, but it seems like you may have tasted it... Not to bash PF changs but I went to my local one, and I was warned not to eat the pork... I forgot about that warning and got sweet n sour pork... next day, had to leave school early cuz I got a bad case of the ass-piss aka diarrhea lol

Never been there. I try not to go to chain restaurants too much. I always find it odd when people say their favorite restaurant is a chain.
