    S4 doorblade? Try to source a factory to make it

    I have some connection to source a factory to make some s4 doorblade( same material, not the fiberglass type)
    I just ordered one set of oem for my car to see how difficult to make it,
    I just wanna see how many people would interested?
    I am not try to sell anything here and just wanna ask for opinion....

    It has been done. His screen name is AudiA4Turbo22. You can search him and send him a PM. They are not fiberglass and from what I remember they are a direct fit.

    I just searched & read over his thread. I don't want to ask him privately until he announce to sell to public. In the mean time, I will try to get an exact quotation from the factory to see how much they can do and produce the first sample ensure good fit and made by good material. But quantity will really affect the price.
    We will use polyurethane or flex material ensure it is good for the winter time (fiber glass is not an option in my mind)
    I live in canada so I want it can go through the cold weather with snow

    wouldn't they have to be slightly different from OEM for you to not get some kind of patent infringement lawsuit?

    Depends on if they have a design or utility patent on them. I doubt they do, but you never know unless you search the USPTO. They should also be marked with the patent number if there is a patent on them. If they aren't marked, then any damages from a patent infringement lawsuit would only accrue after the infringer was made aware of the patent.

    so if it isn't marked with a patent number (but has a patent), the only way the producer can get sued is if he continues to produce it after he is warned?

    i'm the one making them and they are done hence i have the sig, but since i can't sell on here i'm going through Genesis autosport who can. they cost a lot to make, i wanted to try plastic but i'd have to make 2 pieces to make them work and i would have to do some trimming and gluing and etc to make them work not cost effective. Hence i chose fiberglass and this is some good stuff not ur average junk Fiberglass. I can't believe the mods did not accept my company advertisement offer for some stupid reason. It has made everthing 10x more difficult, basically unless u work full time and have a huge place like ECS the mods don't really care to have u advertise on here. Please do not start a competition here for these things, i've spent months of hard ass labor and time to get these to work, i've spent over a grand to make the molds and get everything together and countless hours of fitting and etc. Every freaking thread i make on here about these things gets locked.

    a patent can be defeated as long as 25% is different, if u change material that's 50% right there.

    I hope an attorney didn't tell you that! Blades such as these would most likely be covered under a design patent (i.e. the ornamental characteristics) and not a utility patent. The test for infringement of a design patent has nothing to do with percentages. In light of the recent Egyptian Goddess v. Swisa case, the current test for design patent infringement is whether the ordinary observer who is familiar with the prior art would be deceived into buying the accused design over the patented design. Design patent infringement is somewhat similar to trade dress infringement. Utility patents are a whole different animal, and infringement is determined by reading the accused device onto the claims in the patented device. In a design patent, the only "claims" are the figures in the patent.

    Seriously though - whoever said anything about percentages for infringement is wrong.
