Oh and the ticket was for speeding when the officer didnt see me drive but I hit a curb on a tight bend on the first rain of the year. Yeaaa....he was all nice until the end when he says he had to hand me a ticket...
And I was going 30mph on a 20mph zone and Isimply braked too late...
understeer == teh fail
If you hit a curb, he probably cited you for failure to control your vehicle at speed (or something like that), not necessarily speeding.
I just got a 40 in a 25, which was BS cuz a) I wasnt going 40, and b) he used reasoning that I was endangering bikers on this windy, mountain pass road.
Trouble is, it was like 8:30 pm in pitch darkness, and the road is basically not lit, making it risky for a biker at that hour no matter how fast I'm going. I did a
trial by declaration, which allows you to submit a written statement instead of appearing in court. I requested that the officer provide radar reading w/ date, certification for the radar device he used (which must have a serail # stamped on it that matches the radar he used), and what is called a Road Survey as evidence. If a survey hasn't been done in the past 5 years to evaluate the speed on the road, I believe they cannot uphold the said speed limit.
In my area, the cops have jack-shit to do, so my chances are slim that I'll get out of this. However, they probably DO cite so many people for traffic infractions that I bet he won't remember my exact case. Hopefully he views it as too much BS/paperwork and rolls over, but I'm not really thinking about it until I hear my results anyway since I can't do any more than submit a Not Guilty statement.
Good luck to you!
