    excessive wear/tear protection

I have 4 months remaining on my lease and I have the excessive wear and tear protection. I am over my mileage by almost 18000 miles and will owe $0.25/mile. My question is, will the excessive wear/tear protection eat up any of the extra mileage cost (approx $4500)? The way it is worded on the paper work is very confusing.

On the sheet of paper my wife signed it states exactly as I typed below:

"Standard Coverage: We will waive or reimburse You for Limited Physical Damage charges defined as Excess Wear and Tear in Your Contract up to a maximum of five thousand dollars ($5000). In addition, You agree to pay the Deductible shown above on any claim (miles and/or damage), and agree to turn in Your vehicle within ninety (90) days of the original Scheduled Termination Date."

Then there seems to be a contradiction on the back under Exclusions:

"Any excess mileage charges, unless the total actual miles driven minus the total miles permitted under the Contract is less than 1,000 miles. You will be remimbursed at the lesser of $0.20 per mile or the mileage charge set forth in Your Contract"

Anyone have experience with this and can clarify?

    Thanks...

    Re: excessive wear/tear protection

If your mileage overage was less than 1,000 miles, you would be reimbursed for $.20 out of the $.25 you would otherwise have owed.

Since your mileage overage is not less than 1,000 miles, it is an "Exclusion" to the "excessive wear and tear protection", so I suggest you prepare to pony up $4,500, find a way to get them to agree to roll it into another lease at a reduced cost (hopefully one that actually makes sense to your mileage needs) or buy the car out and sell privately to (presumably?) avoid the overage charge.

Full disclaimer: I do not lease, I am not a lawyer, and I did not stay at a Holiday Inn Express last night.

    Hilarious.

To the OP, sorry, I am of no help when it comes to a lease.

Thanks, I had to read a few more times for it to click, I hate the way contracts are written. Luckily my wife doesn't drive anywhere near the miles she used to, but I don't think she'll be leasing again anyway. The good thing is the economy is in the crapper and there are dealers willing to deal. But if I'm reading the contract right, it's only good if I turn it in after I'm within 90 days of the lease end. So I have another month before I can do anything. Hopefully the financing deals only get better.
