Im asking for these for another reason..

aparently ASP gets their base file, or is helped with the base file from DNA.. A certain person claims they use the same person..

My question is.. Wasnt this someone's custom or tweaked tune?? to me the load says it all.

The load is a move Mark @ ASP always does, I don't think that would come from or be seen on your original base file.

At the end of the day, we all know what is going on. Marc (10secs4), likes to prey on newbs that don't know better...the only person that I think, doesn't run the same ASP like tune, is Robs. I think he may have that tune, but tweaked beyond belief.

The 2 files above are the same....

Marc sells asp, epl and awe. This is public knowledge, be careful of you do and buy knowing this.... There may be more legality behind this then you want to deal with.

Tony, perhaps you can chime in.. when someone brings an EPL tune into your shop to get retuned. What are the ways that you (as a tuner) can figure out whether or not it was an actual tune that you had worked on before, as opposed to being a copy.

The same way AWE was able to tell that the tune Marc sold with his "AWE" car, was not in fact an original ECU sold by AWE...

Can you copyright a configuration? Tweaking a file, via Lemmiwinks or whatever tweaking program you may use, seems to bypass all copywritten laws if you ask me...is Lemmiwinks legal?

also I know AWE has serial ways to tell.. their was a chime in by the fella that had this problem..

An original work that is fixed in a tangible medium is copyrightable. This applies to computer programs (the tune). So yes, an EPL, ASP and AWE tune are all independently copyrighted.

If you are using lemmiwinks, you aren't changing anything in the tune. Lemmiwinks just adjusts adaptation channels, so you're actually using the tune, not modifying it. So that has nothing to do with copyright protection.

If you take an ECU from a tuner, copy the tune and sell that copy to another person, you have infringed on the copyright. The person who did the copying/selling of the tune AS WELL AS the person who bought the copy of the tune (assuming they know or reasonably should have known the tune was stolen) can both be liable for infringment. Very similar to the whole peer-to-peer network and copyright issues the music industry is dealing with.

To throw another issue into this, read up on the Digital Millenium Copyright Act of 1998.

You don't need to register anything to have copyright protection. The only time you need to register a copyright with the Copyright Office if you are bringing an infringment lawsuit. And you can simply do that right before you bring the suit.
