    I suppose it has to do with a negligent architect that I hired and I wanted to get some info from a working tect and a lawyers advice if I had a negligence case.

    In short, I paid a tect, he made out some plans and he had to scrap it due to information's he failed to find out, 5 months of his work and my time, reasearch etc... back to square 1. I paid for his time only to end up with nothing. Paid him, the engineer and soil report 10K+ so far. And now to cover up his screw up he suggests to go to the board of Building and planning that will cost and extra 2k to see if the board will allow the plans to go through with no garantee of acceptance.

    I don't want to say too much on here, but you may have a breach of contract claim rather than a negligence claim. You may actually have an issue with the negligence claim for a few reasons under the circumstances. Shoot me an email...at the very least I'll have a referral for you as the firm I worked with before I became general counsel for a company actually specialized in construction law (www.gglts.com).

    I'm neither of the above, but I am a City Planner... and I have a couple of questions for you.

    Is the guy a Licensed Architect? If so, you can register a complaint with the American Institute of Architects www.aia.org. If not, you should not have been using him anyway.

    Just curious, what are you doing that your drawings would cost 10K? Based on the posted information, your architect created plans without understanding the restrictions of your local planning code. Next, he tried to get it approved administratively and due to the size of the project, its required to go through the entitlement process. Typically, your project manager will work with you to get your project approved. Most projects come with a recommendation for approval from City staff unless the project is pathetic and the architect won't listen to staffs recommendations.

    I just re-read my post and wanted to clarify something because it may have come off wrong...there are professional rules of conduct on solicitation which is why I asked for you to email me. I know what most may be thinking...attorney...rules of conduct
