What rights do i have here, anything legal? To get some restitution...Kinda long

As an old post i wrote up http://www.audizine.com/forum/showthread.php?t=217827 i was hit in a parking lot so my side and hood were messed up and insurence isn't worth going through since it is costing $1300 and the deductable is $1000, anyways...I brought it to a paint shop on the 7th(monday) of this month. They told me they would have it till Friday...Well friday the 11th comes and they are not done. They tell me it will definetly be done monday, monday comes they say "they are sorry it will most definetly be done tuesday." So tuesday the 15th i go in and it is done.But I find residue on the windows in between the door and heres the kicker, some scratches arent fixed yet and the paint looks unfinished!! The owner comes out after i told her what happened and she apologized they missed some scratches and didn't properly finish the car and said she would never let it out like this someone must of missed it. it should be been sprayed one more time then buffed. So i need the car for wed (the 16th) so i take it and say i'd bring it back thrusday (the 17th). Well thursday i bring it back and they call me to say i have some chips on the hood i should come look at. Weird when i got it back no chips they said i must of drove behind a tractor trailor for some time (not at all). I said i've driven once a week on the thruway since i've had my car and have 2 minor rock chips NOW i have 5 a day after it was painted!! So i go in and they say the paint might be defective but they need their rep to look at it first. So i leave it there and was told i would get it back soon. So today they call me up and say its done but they didn't touch the hood since they didn't work on it..."wait u did work on the hood...fixed a dent and re-sprayed it ect..." Oh i'm sorry i didn't see the paperwork for the hood it IS defective and if gonna be convered under their insurence. We can get it back to you wed (the 23rd) So its been a total of 16 days to fix a dent in a hood/scratches on the side. They never offered a loaner car or money off. Is there anything legal i can do to get money off ect...its took 16 days to fix door scraches/dent AND they messed up.

try nicely complaining (possible oxymoron). explain to them that its taken x amount of days to fix such a minor problem. on top of that the car wasnt even done properly, and you had to take it back and forth numerous times. tell them you arnt really satisfied with the job they have performed. tell them as of right now, you would never refer someone over to their business. ask if there is anything they can do as far as a discount since there were so many mistakes made while trying to fix your car and it was so time consuming.

if they dont, they wont offer you anything. and then you let them know again that you will never be back, you will never tell anyone to go there, and you will actually make it a point to make sure people DONT go there because of the crappy service you recieved

16 days and never offered a loaner for weekends or time after they messed up...just woundering if there is anything legal i can do like a lemon law when they take 3 times to fix your car ect... I mean not to that extent but i should get something for this ya know? Try having your audi gone for this many days it is really driving me nuts!! I miss her

Body shops are under no legal obligation to provide loaners (free or otherwise). I also don't believe that bad paint jobs come anywhere close to fitting the definition of the "Lemon Law" and are just reflections of a bad/poor body shop that people should avoid using.

Sorry to hear. You really don't have legal cause considering the shop is willing to fix all of the damage, redo work, ect in order to satisfy you. In a situation like this you basically get shafted while the shop tries to correct their mistakes. There is no requirement for them to provide a rental car or discount the work for your inconvienence.

You really won't win in court unless you prove they caused you real harm...as in didn't finish the car, caused you to missed work, lose wages, ect.

I would definitely ask them for a discount considering the trouble they've caused you. Maybe they could cover your rental car if you had one. Be nice, be reasonable, and they may discount it or comp some of the repairs. Other than that, lesson learned, don't go to their shop.

i will if it is stilled bad(not corrected) on wed and/or they don't try to make me happy. If they come through i'll give them the benifit of a doubt this is the first time. It is located in CNY tho

Sorry man, that sucks.

They did nothing illegal, but they did do a very shitty job. I would never expect a rental from a body shop, either borrow a car, get rides, or pay $20/day for a decent rental car.

The first time they had the car it wasn't that big of a deal, but they didn't even finish it. That is uncalled for, and they probably did a shit job quick at the last minute because they knew you wanted it. Then with them saying they won't fix the hood... That's just an unprofessional shop that doesn't have their shit together. Just nicely complain and say something about how you shouldn't have to come in this many times and get pushed around like you did, and they'll probably give you a little discount off your original bill or something. But don't pay any more than the original bill, they should fix their defects and mistakes for free.

But no, nothing legal going on.
