Joined the club! New avant owner

I sold my 1997 Audi A4 1.8TQM sedan wedsday, so with a little money saved up, I bought an avant!

It's a 2001, 1.8l turbo (RED T), Quattro, 5 speed! Loaded!
95k miles, new timing belt + ect.

What do you think? I payed $6000

I don't think your t-belt was replaced :~). I bought this on ebay and found another afterwards. I called the guy and he said he never replaced it. This was the one in rochester, ny so I guess the guy relisted it quick. Problem is he wont give me my deposit back. Good luck with it though, you'll love avants. I just got mine yesterday and love everything about it.

I called schmits auto where all the work was done, the t-belt and junk was done at 80k.

I got another with only 53k in nj. I did not feel like driving up that far anyway but I was deff going to untill I found this next day. Did he tell you that I am trying to get my deposit back.

Haha yeah, It's not a bad car, especially for the price.

The lowest mileage car I've ever owned was 150k, so this is brand spankin new in my eyes.

The K03s is what really sold me though. 20+ more horsepower than my last Audi, cant wait to chip it.

Its funny that we both were interested in the same car! He never said much more after the whole "He gave me some bs about losing his job and whatnot"

He never said in the add the deposit would not be given back if I were to back out. I even said I will take half of it so he could pay for listing and relisting fees. Ya thing is if that actually happened he would not give it back. Help me play the card still so I can get some of it back. Otherwise idk what to do. Maby paypal will back be up. Ps k03s not the best thing in the world but whatever floats your boat. Its 170hp but when you chip it only 210 much like the regualr k03 where you get the same if chipped so its not a big deal.

Well, the car I had, used an MTM Chip. It was 189 horse, 215ft/lbs of torque.

This car with an APR chip puts out 215 horse, 247ft/lbs of torque.

I always thought deposits were considered non-refundable. No matter what happens. You should always be 110% sure of buying a car/home when using a deposit. Bc like I said. You don't normally get it back.

Well I think it really depends on the situation. If your renting something and put a deposit down when you return the item you get it back. When you buying something I though it was just to hold the item then if you bought it you already paid 500 of it or you get your 500 back. It never said non-refundable in the add so it could turn out to be a win-loose. He never said this but I didn't do that. And at least if I don't get it back I know who bought it so I will feel better if they turn out good with it.

Just FYI, the only thing different about the K03s is the shaft... it is a little stronger. Besides that the turbos are exactly the same. The difference in hp between the K03 and the K03s is due to the fact that the stock boost setting is higher on the K03s; hence when chipped (to the same boost pressure), they both put out the same power. So I really hope that isn't "what really sold me"

At any rate, nice buy! I love the avants as well (C5 A6 here)!

I agree I have always considered deposits to be 100% non-refundable. The ONLY reason for it to be refunded is if the car is not as described or has a mechanical issue before it changes hands... basically the deposit is compensation for lost time on the market if the buyer backs out for any reason that is not related to the condition of the car.

The guy who bought my GSXR in April wrote up a contract stating that the deposit was 100% refundable. When I read through it I noticed this, but didnt amend it b/c he was very serious about the bike, had seen it in person and just had to get the cash for the transaction. It did concern me a bit, as what the hell is the point of the deposit if you can just back out and get it back? Might as well not take one at all. This guy was a total d-bag and a lawyer (hence the custom contract lol), but he did buy the bike so I guess it all ended well.

Why did you back out? If it was b/c you lost your job, then frankly, I dont see why he should give you the money back... I probably wouldn't.

Thank you thats what I was trying to explain about the k03 to him but its all good. And about the deposit. It was not because I lost my job but I am still low on money. I bought the car and had 100% every intention on buying it until the next day I saw a more locally avant with half the miles and just could not pass it up no matter how much deposit I already paid. I email the first guy and explained how I really was sorry and I would even settle for half of my deposit but he said the amount of the listing plus to be relisted was more than 500 which I know is not true so I said take 250 and ill take 250. Then I found out this guy bought it and he never even relisted it on ebay. So all I should have to pay is my listing fee. He is a very nice guy just sort of seems almost greedy to me not to even give back half just to be a kind person then everyone is happy.

same scenario happened to me when i got my avant. i was going to buy one from AZ member fatezero down in socal, (12 hrs from where i live) i was dead ass serious about buying it so i gave him a 2000$ deposit towards the 11000$ final price, well like two days later i was in portland on business and a block down the road from where i was working was a beautiful b6 avant that i just could not pass up so i pretty much bought it right there on the spot. fatezero was VERY cool about it all and we agreed that id just give him 250$ fee for canceling the buy, and he refunded me the other 1750$.
i think that since the guy obviously still sold the car in a timely fashion he should refund your deposit 100% i mean jesus christ we are all human and shit comes up in life like that. now if he had to sit on the car for another few months because of you backing out thats a different story, as of now i think the guy is a douche if he doesnt refund your money in full, and anyone else is a douche to if they would act the same way HE ALREADY SOLD THE CAR so he didnt lose anything in the deal. my .02

Looks like a decent car. One advantage of buying an older car is that you'll have more money for mods!! Good luck with it.
As far as the deposit thing goes if it wasn't declared that it was non refundable I think he should give you at least a partial refund, especially since the car was sold pretty quickly and you didn't take it off the market. I think you should have told him the truth though instead of a lame excuse and then buying another car. Seems as if both of you guys got cars you wanted so that's all that really matters.
