I live in Wakefield, I already appealed the ticket, its not like I was going 90 in a 40 zone, I was "estimated" going 45 in a 30, but it was because I was at a stop light on a two lane lane road next to another car, this road merges into one lane and then becomes route 1, which has a speed limit of 55 MPH. I only sped up briefly to get ahead of the person next to me, because we were going the same speed and about to merge into each other!
In doing this he must have heard my exhaust, because I think I was in second gear so the RPMs prob got high. My exhaust is normally very quiet, that is one of the reasons that I bought it, I only replaced the mufflers too, the resonators, cars and piping are all stock. It is silent when just cruising, esp in higher gears, and what makes me mad is the officer followed me on the highway for quite some time, so he must have heard how quiet it was/can be. The officer did not have a decibel meter but he said it doesn't matter because I modified it, it is louder and that makes it illegal, I told him that I bought the car with the exhaust on there already, and he called my car obnoxiously loud.
I own a decibel meter myself and could measure it but I don't really think it will matter, I plan to ask him if he knows how loud a stock A4 exhaust is (anyone have this figure?), and then ask him how loud mine is, for all he knows and without measurements as proof, my car is as quiet (or loud) as a stock A4. I really hope I can beat the exhaust part of it at least, the speeding part is up to the magistrate I guess, but I plan to take some pictures of the area so he gets the idea and how it merges and I want to see if there are any speed limit signs on that road, because I don't think there is. Here is what I found on MA exhaust law, the part in bold is the most relevant part, BUT I am not actually sure if it is in effect yet or still a bill though...
"Section 16. No person shall operate a motor vehicle, nor shall any owner of such vehicle permit it to be operated upon any way, except fire department and fire patrol apparatus, unless such motor vehicle is equipped with a muffler to prevent excessive or unnecessary noise, which muffler is in good working order and in constant operation, and complies with such minimum standards for construction and performance as the registrar may prescribe. No person shall use a muffler cut-out or by-pass. No person shall operate a motor vehicle on any way which motor vehicle is equipped (1) with a muffler from which the baffle plates, screens or other original internal parts have been removed and not replaced; or (2) with an exhaust system which has been modified in a manner which will amplify or increase the noise emitted by the exhaust. No person operating a motor vehicle shall sound a bell, horn or other device, nor in any manner operate such motor vehicle so as to make a harsh, objectionable or unreasonable noise, nor permit to escape from such vehicle smoke or pollutants in such amounts or at such levels as may violate motor vehicle air pollution control regulations adopted under the provisions of chapter one hundred and eleven."
