    Well this is the 2nd post from the "Ahhhh so damn pissed"
    So Damn Pissed aaahhhhh

    Well after 4 days of running around and tring to figure out why my license is suspended i got it, but not back. The DMV, The Traffic Court, and the Department of Revanu took me on a nice ride that sent me from place to place and back and forth. Because i have the receipt for the ticket being payed and no one knows why it did not clear on the DMV's end.

    Well it turns out that even tho the court took my money for the ticket and they have it and it says i have 0 ballance due. Since i payed with a check "being told it was gonna clear in 72 hours, which ment, We will take ur money in 72 hours but not clear it" well they are holding it for 30 days.

    So now for me to clear it, i will have to pay for the ticket again, which is $657 (but now cash) and then they will clear it, and then it will take them 8-10weeks to give me the extra $657 back. WTF is going on.

    Also i still don't know what to do when i go get the car out of the tow yard considering that they did not use a flat bed to tow the Quattro. Will it even drive when i get there? lol What a week!!!!!!

    Why wouldn't they just cancel the cheque or you cancel the cheque? If it takes them 30 days to clear just tell em the cheque won't clear, get it back and pay cash.

    You had better get a little more proactive here...

    Your car is imponded, they are allowed to charge you an average of $145 for the tow in the Bay Area as well as an average of $40 per day for storage.

    If they impounded your car for 30 days per CVC Sections 14602.6 and 14607.6 (you car may be impounded for up to 30 days, this is because you have committed a misdemeanor in the State of California.)

    If you presented the court with a check and they cashed it, your bank will have record of this.

    These are the steps you need to follow to get you license back.

    1) Contact DMV (show up in person) and get a printout of you driving record to show all offenses, DMV will have the court that suspended your license as well as the docket number of the offenses the license was supended for.

    2) Contact you bank and get a copy of the check that was cashed, both front an back.

    3) If that check was written for the offenses that DMV suspended your license for, you need to go back to the court and present the check to the court clerk, the court clerk will then give you a copy of the abstract that the offense has been cleared (some courts send this information electronically to DMV).

    4) Go back to the DMV with your abstract and pay the $100 license reissue fee.

    5) Do not waste any time doing this, you are being charged about $40 per day while your car is impounded, fees will exceed $1200 for the month.

    There are many reasons that the court may have not applied the $$ from the check to your docket, the most common reason is that the check was dishonored (I am not saying you bounced the check, this is the most common reason though). Court clerks may make mistakes however, it is possible they did not apply the payment to your docket correctly, getting a copy of the cancelled check will help you in this case.

    The main thing you have going against you is that in California, your license is not suspended until either a officer of the court, DMV or a peace officer notifies you. Somehow, someway you were served notice, if you do not have your correct address on file with the DMV, they would have sent you a notice of suspension (notification from DMV).

    As far as the court is concerned right now, you were driving on a suspended license (another $1000 ticket plus 30 days in jail). The most likely have sufficient burden of proof to convict you, all you have are the mitigating circumstances surrounding the check you presenmted to the court.

    See all that would of worked but guess what. They don't do abstracts anymore. Thats where im getting screwed. Everything has to be electronic and go threw Sacramento. The DMV in Sacramento has to get it to clear it. But they need the FTP cleared from the court. And the court will not clear it cause its a check and it has to stay 30days.

    Put a stop payment on the check, pay in cash.

    i cant because they already took the money out.

    UPDATE:

    well i went today and payed for the ticket in cash again. And now i have to wait till money so it clears from the DMV and then i can go get the car. yay As long as its not broken and i can drive it
