last night i got a ticket in san jose for "alcohol in public." so retarded, i wasnt driving i was with 3 other guys (two who had been drinking with me, we had our drink in a 44oz plastic cup and there was about 1-2 sips left in the cup (if i remember correctly) so basically i took one sip of it when i got out the car and the two other guys had the cup and they put it down. by the passenger seat. so we start walking away from the car and two cops start walking towards us. so basically he talked to me out of the rest ( no idea way ) besides that i might of been feelin a lil hyphy haha. so he walks by us and asks me if i had been drinking and iw as like yeah i had a few shots.. and then he patted me down and walked by our car.. and was like so what did u have to drink.. i said coke and johhnywalker blah blah.. and he smelt the cup and was liek could u come with us.. and i went and he made me stand infront of the car and took my ID and gave me a ticket.. for.. "10.12.010 SJMC Drink .. Alcohol in Public" He didnt smell my breath, nor did he give me a breath test thingy.. ahha funny thing was that he had to bust out his lil booklet of penal codes to pick out the one. So i looked online to see what it is.. and i cant find it?
shit we didnt even drink in public.. once we stepped outside with a damn 44oz cup from chevron lol they came right to us. I know its different if we had like a bottle on us or were doin stupid shit. but we werent lol.
anyways, besides this huge rant, anyone get a ticket for this?

oh no!!! that's horrible!! i remember while my friends were going to SJSU.....they got thrown in jail for jaywalking!!!!!! they stayed their the whole night!!! imagine that?!? jay walking?!?!?!

yah but i wasnt like walking around with a 40oz lol..
its just a fine.. but i know i can fight it and prolly get it reduced to 10 bucks

Nope... Last time I was in San Jose was for a My Chemical Romance concert and I drank a beer outside while walking to the show. Cops were all over but didnt say nothin'

what did you expect if you had alcohol in a cup in your car when you were driving? youre lucky he didnt give you a ticket for drinking and driving because he could have based on probable cause.

That would be a drastic grievance considering he wasn't illegally intoxicated at the time. He only had beer poured in non-designated cup out in the open that belonged to his passenger. In all the cop made the correct citation.

I got a ticket for drinking on the beach - especially being under 21- in malibu (a little ways down haha) and it was a 75 dollar fine with no penalty or anything just a citation

hey there buddy, no need to jump to conclusions. i never drink and drive knowing im underage.. i had a sober driver and usually cops who arnt dicks' would rather care if the driver was drinking not the passengers..

Open container is a citation no matter whos got it.
Drinking in public is also a citation.

nah dude, i didnt mean you were drinking.. i just meant its along the same lines as having an open container in a car. Cops dont care, its too much of a risk to take. Ive had friends that got DUIs when they werent even drunk for stuff like this because its the Cop's word against theirs. its BS, but it can happen.

yeah i got one of those back when i lived in NYC, i was drinking a Bud that i just bought in a bodega (say it with me now...Bo+Day+Gah.) out of a paper bag, i walked into the sub, and i saw a cop, so i threw the whole bag away, the cop actually searched through a nasty subway garbage can..hahaha, pulled out the can said is this yours, i said no...he gave me a ticket anyway, I fought it, and got away with it cause the officer didnt put a date on the ticket...dumbass.
long story short cops don't like anyone having fun while theyare on duty...
