Ok,
On my drive this morning I had my favorite Dave Matthews song playing, sunroof open, sport mode, driving the backroad to work. Nice twisties, followed by a great 10 mph left hand 90.
Ahhhh... took the turn at 53, hit the gas at the apex and rocketed out to the straight hitting 90... haha! (disclaimer: I was really going 10 mph under the speed limit as I NEVER speed!)
felt like butta, never even a tire squeak! (Disclaimer: not surprising as I was going 3 mph)
It reminded me of my days driving above Stanford on Skyline with my Porsche 911...>.. that's in California for those who don't know....(disclaimer: really, I had a GMC Pacer and I never went more than 15 mph)

Big Brother IS watching. Anything written in a forum can be used against you in a court or to void a warranty. Ask me how I know...

Alright, I had another dream today.
It was weird.Driving home from work, see this black 335 coupe. The guy driving wants to gun it a little. So I do too. Soon I found the 335 in my rearview mirror. then a light. 335 indicates to me that he wants me to try and 'catch him' and starts gunning. I am thinking this is like when I was in high school and had my 1970 Plymouth roadrunner 440+6.... nope, bmw vs audi....
anyway, once the light turned, it was no time at all to see the 335 behind me.
then the next liught and he wants to see my rear end again.. what is wrong with this guy I am thinking... he really likes my tailpipes?
Once again I abliged him.
next light, I let him start, I never hit the gas until he is ahead - once again I show him my taillights....
then he got stuck behind a semi and I never saw him again...
weird dream huh. I hope in real life my Audi can FRIGGIN SMOKE A 335! I never realized they were so slow...

Lets just say that on e90post, it appears that if you mention the name of a dealer or anyone who works for the company you get flagged. I went in to get my fuel pump changed and my SA said that I couldnt get it done with my mods on the car because the warranty is voided. Id have to take all the mods off and put the car back to stock to keep my warranty. I blew up at that mentioning that the fuel pump was an obvious issue and that it wasnt the mods that caused it.
Then he proceeded to pull out a stack of threads from e90post with my profile name highlighted. They said we know how much you talk about modifications and assisting people in putting them on.
It was at that point I decided vehemently never to go back to BMW.

Hate to say it (not really) but that is a single indepentant dealer monitoring a popular site for mods of their make of car. Not big brother. They also cannot legally refuse to fix something citing a mod unless they can prove the mod caused it - there is a law covering this. Additionally, unless they have some way to corroborate that your screen name is YOU, they can only assume.

Federal law prohibits a dealer from voiding your warranty just because you are using aftermarket speed equipment, with only two exceptions: the warranty can be voided if the aftermarket part causes damage, or adversely affects the emissions or the emissions system. In recent documents produced by the SEMA (Specialty Equipment Market Association ), a trade association representing specialty automotive parts manufacturers, the following quotes have been extracted:
"The vehicle manufacturer is not allowed to void the vehicle warranty just because aftermarket equipment is installed on the vehicle. This protection for consumers is the result of a parts self certification program developed by the Environmental Protection Agency (EPA) and the Specialty Equipment Market Association (SEMA).
"Under the program, if a parts maker completes the EPA process of self-certifying its parts, the vehicle manufacturer cannot void the warranty even if the certified part has failed and is directly responsible for the warranty claim. In cases where such a failed aftermarket part is responsible for a warranty claim, the manufacturer must arrange a settlement with the part manufacturer, but the new vehicle warrant is not void under the law. "If the failure to honor a claim involves the new-vehicle warranty, and it appears that the manufacturer is improperly denying a claim, the incident should be reported to the Federal Trade Commission (FTC). The FTC is responsible for monitoring compliance with the warranty law; the agency's telephone number is 202/326-3128."
Now that being said, I personally have seen GM void a friend's warranty on his ZO6 because they were able to prove that he had an aftermarket HP tune when the engine failed. If you visit the Corvette forum, you will see that this type of scenario is quite commonplace. Sure, it's easy to say, "screw that, I'll get my lawyer involved." But, unfortunately, in some cases it just isn't that simple when going up against a large corporation.
IMO, it's much easier to try and get on friendly terms with the key people at your dealership, or simply stay under the radar.

No, actually BMWNA was trolling the forum and was very open about it. And the law you refer to is the Magnusson Moss act which in all actuality doesnt have a leg to stand on anymore. Its a law that is brought up all the time but was only really valid back in the 70's and 80's. Not anymore with aftermarket "performance" parts.

Wasn't either Subaru or Mitsubishi voiding parts of the new car warranties on owners that posted about autocrossing a few years back?

this is why you always use a custom/fake plate or take all your plates off at the track/strip

If car makers didn't want owners to speed or participate in events sanctioned around speed, why do they continue to make cars that go fast. If they want to make cars and not have to worry about repairing things, they should stick to things like golf carts, riding lawn mowers, and Zamboni machines. Ok, bad example on the first two as there are events to race them.
That really stinks about the Sub and Evo owners. There's really no chance fighting against the big machine of an automaker, because their pockets are so deep, when they void your warranty too.
I never thought about taking my plates off. That's a great idea.
Now it's got me curious, how does Audi view the track events put on by the Audi Club? Would those events be viewed as "sanctioned" and anything broken there is magically better than a part breaking at an "unsanctioned" event?
