A friend recently bid on and won a 2002 roush 360r. Item # 300191015619 http://cgi.ebay.com/ebaymotors/ws/eBayISAPI.dll?ViewItem&sspagename=STRK%3AMEBTOX%3AIT&viewitem=&item=300191015619&_trksid=p3984.cTODAY.m238.lVI

Unfortunately he got a call from the the seller who said the car was sold for $22,500. Ebay also contacted him via mail asking if he had talked to the seller about something and to check either a 'yes' or 'no' box. He checked the 'no' box. Now I assume the seller is under contract to sell the car to the winning bidder, but it's obvious the seller has changed his mind on putting his car up. Could he if he really wanted to just not give it and have some penalty hit on him. My friend really wants the car and even borrowed 7k from his brother to get it. Ebay is closed till Monday so we can't call them. Thanks Guys

I think the seller has the right to end the auction early or to sell it locally if they have it listed. However, I also think that they need to disclose this.

"NOTICE TO BIDDERS - We reserve the right to cancel all bids and end an auction early should the vehicle no longer be available for sale".

There is no legal contract if you win anything on eBay. Looks like the seller expected more than what it actually sold for. Seller does not have to honor anything on eBay. All your buddy can do is leave negative feedback. Even if your buddy paid the $500 deposit or even paid in full the seller still doesnt have to give him the car. Seller would just have to face the negative feedback and will have to refund all money.

Some sellers are just shady. I have never had to worry about it and maintain 100% feedback as a seller and buyer but thats just me. What that seller should have done was post the car w/ a high reserve like how I did my Avant to get a feel on what folks would actually pay.

hey wait....they do have a right to end the Auction early.......BUT they didn't. He did not End the auction at all....so he is definitely getting bad feedback.
