well, I just got a ticket for doing 60 on 40 mile zone. But I can swear that it was the car in front of me who did the sixty. I was doing 50 which still is above the speed limit but a lot different than freaking 60.
So here is my question: can they use laser/radar guns while NOT staionary?

And what kind of questions or points should I bring up in the court?

Did you get hit with RADAR or LIDAR? If it's radar, and he was moving, the chance he tagged someone around you is FAR higher.

Lidar is a pretty narrow beam...About the size of your liscence plate. It's usually a pretty obvious hit or miss.

I'd definately fight it, but I have no idea how you'll prove anything...

I'm gonna have to say that you will more than likely lose in court, if he was moving he can always say he was also pacing you. I really think that your best bet is to go into court and plead guilty. 9 out of 10 times they will give you a fine, traffic school and supervision. really not a bad deal as it will not stay on your record as long as you do not get another moving violation in the supervision period. trust me i of all people would know. my driving record is not so hot.
