    Anybody know Nico a.k.a. SEXICÄN?

    Hey guys.

    I bought some used K04 turbos from this guy in December. His communication was prompt and he shipped them quickly with a tracking number. When it arrived, I found only 1 turbo inside. After examining the box, I found a hole on the bottom where I presume the other one made an escape. I notified him immediately and he said he'd call UPS. I also opened a claim with them. A couple of weeks passed as I tried to get them to pick up the package for their investigation. About a week after they picked it up, the status was updated on the UPS website. It said the investigation was complete and "we will notify the shipper about the details of the damage claim." Having not heard from him or UPS, I called UPS to find that the insurance claim was awarded to the shipper and the package was shipped back to him. So he now has my payment ($710), the insurance claim ($126), and the 1 turbo. I've been trying to get a hold of this guy ever since and have not had any success. I tried to open a dispute with Paypal, but it was denied because it has been more than 45 days since the transaction. I had no reason to open one earlier because he shipped them as promised and I didn't believe UPS would return the package to the shipper.

    That's pretty crazy, Nico is a stand up guy but hes been out of the country for at least a week for vacation and I'm not sure when he'll be back.

    That's good to hear. I'm hoping there IS more to the story. I understand circumstances come along. However, there's nothing more to the story on my side. I have been completely transparent.

    I just arrived back to WA tonight from Puerto Rico.

    I thought I sent you a PM... But Internet connection sucked there.

    If you want to call me out on me being some shady seller, you must not know me very well...

    You paid me for the turbos. And at that point they are your turbos's not mine. I shipped out YOUR turbos. Ups lost your turbo. You filed a claim and your claim was approved. So ups currently still has you're turbo and your claims check for $130. I fail to see how I owe you $710 when I personally didn't lose or ship you false things. I have never once sold shitty stuff to anyone and don't plan on starting now over $700.

    If you want me to insure the package for more than $100 (as you it approved for) you should have asked as I would have gladly raised it up at your expense. But you didn't. I do fail to see how I owe you a refund. If you feel I do, I'd like to hear your explanation... I don't mind shipping your your turbo and refund check again to you as I see that is the fair thing to do.

    All in all I haven't been in town to pick up the turbo or the claims check. You can always call me as my email to you had my cell. Ike I said I will gladly sent you the 1 turbo and claims check since they are yours.

    Sorry if spelling is bad as its 4am PR time and 12 my time...

    I agree with you. Nowhere in my post do I state you owe me $710. I did file the claim, but it was approved under your name and you were notified by UPS. You currently have ownership of the turbo and check. If they gave it to me, there wouldn't have been any need for this. The Paypal dispute was opened as a last resort.

    I didn't know about your situation. I emailed you, PM you, and called you 3 times. It went to voice mail each time. I'm certainly not pleased about having to go on the forums to get a response from you. Please send me the turbo and check amount. You can deduct the shipping cost.

    I'm sorry I wasn't able to better communicate when I was in PR as I am back now. I'm off Monday and will have it all shipped out to you Monday. . I'll pay for it To get shipped back to you.

    Again I'm sorry you felt I was a bad seller, I wish things didn't turn out the way they did with UPS.

    IMO I disagree with sexican, its your responsibility until he received the item. Cant believe that you did not insure the package would have been like $10, also if you had packed them better this probably would not have happened. Think if you were the buyer would you be ok with being out $700 and having one used k04?

    I'm not "okay" with paying $700 for one turbo. Unfortunately for me, UPS took the responsibility for the damage and approved the claim so I can't fault the seller. Furthermore, I agree with SEXICÄN that insurance should have been elected by the buyer. Someone had to get screwed and this time it was me. Oh well, lesson learned. Thanks for your concern guys.

    Exactly. When the buyer pays, it is the sellers responsible to deliver the items as described in the original ad. If shipping is an issue, it is the sellers responsibility to insure the item so that something like this doesn't happen.

    Pretty much sums it up.

    As the seller, you're responsible for protecting yourself (with this I mean, proper packaging of the item which clearly wasn't done here, and insuring the package correctly) and completing the transaction FULLY which means your job isn't over until the buyer has received what he paid for in the condition it was promised.

    I'm not sure which planet some of you guys are living on but if the buyer is paying for shipping and the buyer declined to insure that shipping for more than $100, than how in the hell can you blame the seller for following what the buyer wanted?

    Also, that packaging job does look pretty shitty but something that size doesn't just fall out of a box without some help. Considering how much packing tape is on the bottom of that box, I'd bet some UPS employee along the way helped themselves to that other turbo.

    Update 2/25/12:

    I got the turbo and insurance check from SEXICÄN this week so I consider the matter resolved. I'll be posting the turbo for sale shortly if anyone needs it (I believe it's the passenger side). I'm not sure of the condition, but I was going to rebuild the set.
