You could sue them, but you would have to establish that a majority of the cars did not meet their horsepower figures when new. At this point, that would be nearly impossible.

Is hp same as bhp? I always thought that hp is just referring to horse power that motor produces and bhp to horse power that are actualy passed to the wheels...maybe our motors do produce 420 hp but does all of them go to the wheels,I don't think so :)

HP is the same as BHP (Brake Horse Power).
WHP (Wheel Horse Power) is always going to be lower.
The manufacturer specs BHP/HP, not WHP.

CHP and BHP are actually different. CHP is at the crank, and BHP is a hub mounted dyno unit, IIRC....

BHP takes into account the power loss from the drive train, but unlike WHP, it does not take into account the resistance of the car's weight and friction.

Even more confusion comes from DIN vs SAE HP, which are about 1% different.
Brake horsepower is a means of measuring horsepower at a brake. It measures how much braking is required to hold an engine's output at a certain RPM. It's just a different way of measuring the same thing.
Anyways, OP, have fun with that class action. You will probably make some lawyers very rich, and perhaps some owners about $20 richer in the end.

Guys, read up on the Honda situation. The real news there isn't about a class action. It is about a lady (lawyer) that sued Honda in small claims court. You have a much better shot of winning something here and don't have to pay legal fees. The limit you can win varies by state. In Cali, where this lady was, it was $10K and she ended up winning just under that amount.
I personally don't think there is much hope here.

Next time you hear the term "brake dyno", you'll know what they mean...
to the OP: Instead of paying a lawyer and suing the company that made the wonderful car we all know and love... just spend the $ on a couple mods to get that power back you feel you've been "cheated" out of.

The lawyer who won a similar suit against KIA called today. All of our cars have between 300-330 whp tops. $ on a couple of mods.... other sites have figured out that it costs about $100/hp. So to get to 420.. do the math... I love my car, had it since new, but now i'm pissed.. Thanks for listening

Audi never said it would have 420WHP. It only said it would have 420BHP which after drivetrain losses equates back to about 330whp. Factor carbon buildup in there and you get 300WHP or less.
If you are going to waste time on a lawsuit, why not waste it on a lawsuit over carbon buildup and the dealers not dealing with it.
