I misquoted. Car doesn't have to be yours, but all cars must be Audis! lol The pictures DO have to be taken by you. Here's the previous rules:
THE RULES you must follow
•You must be a member of Audizine
•Photos need to have be taken by you
•Any and all vehicles must be Audis
•Needs to be a recent photo, taken within the past 12 months
•Photos must be in color
•Little to no use of HDR
•Original file size (for print) must be 300dpi 8"x10" or larger

^ Well actually no. Someone else can drive your car and you can take the pictures. Also, nowhere does it state that pictures you submit must be of your car. I don't see how this can be a photography contest if people are submitting pictures they didn't take. This is not the "3rd annual Audizine post the coolest high res picture of an Audi from your hard drive" contest.

P.S. i think we should try to get 1 of every era (b5/6/7/8...) AND one of every make (a4,6,8 etc) That would make it interesting.
PSS : wow even being a Terrible photographer and having a pretty lame stock (sleeper) car, it is very hard to choose what pics to submit. lol

WOW! Nice shots. They are both great but if I must choose one, I would pick the top one. I like that one because the car is angled versus the bottom one. However, I like the perfect snow arch over the windshield in the bottom one. I am not sure where I would want to be in this scene as I would have loved to shot those pics but would have also loved to be in the car driving. Where were you?

for the record... paid photo shoots are typically "work for hire" and therefore the copyright is owned by the person who paid for the shoot... not the photographer
that does not however mean photo attribution should be ignored (attribution is considered a "moral right" and is covered differently from copyright under the law).

I don't believe that is true. When you pay for a wedding photographer, the money you pay is for their services, album, video, and copies of the photographs. The copyright is still that of the photographer, you own the copies but you can not distribute it and claim it your own. You can not give consent on behalf of the photographer. When Anthony mentions that you have to sign a consent form, the photographer has to sign and not you. You paid for the photo but the creative license is still his. Your paid photos can still be submitted, but by the "Photographer." Even if you give credit or proper attribution, the photographer still needs to know that you are re-distributing his/her work. If you win or get selected, the credit should be given to the photographer and not you, even if you paid for it. Paying for photos does not give you artistic merit.
EDIT: Didn't read closely to your "work for hire" statement which is true, but it all depends on the written agreement between both parties.
"If a work is created by an independent contractor (that
is, someone who is not an employee under the general
common law of agency), then the work is a specially ordered
or commissioned work, and part 2 of the statutory definition
applies. Such a work can be a work made for hire only if both
of the following conditions are met: (1) it comes within one

Again, the official word here in regards to this contest is...
• The photos must be of Audis
• The photos cannot be more than 12 months old
• You must be an Audizine member to enter
• You must have rights to the photos you submit, as you will need to grant Audizine use of right to the photos via a signed contract
If any of the above conditions aren't met, the entry will be omitted and cannot be in the calendar or poster.
sf_loft: I worked on this stuff for several years with the legal counsel for Wikimedia as part of my job on Wikipedia as an administrator...
so I'm pretty confident in my stance at least with regard to US copyright law, but not being a lawyer myself and knowing that circumstances do vary based on country I wont say they are 100% of the time WFH, which is why I said "typically"
obtaining and maintaining works that can be freely reproduced without a non commercial restriction is a lot more of a headache than most people realize... so glad I dont deal with this shit for a living.

It would be a more "fair" contest I think, if not only were the pictures owned by the submitee - but the car(s) also...
If I may ask, why is owning the car more fair? My impression was that it was a contest of skill, not the biggest checkbook...

As sf_loft pointed out, this could not be further from the truth. The only case this applies is if you are working hourly, ie: I take photos for use by Wal Mart on the clock. In any other instance full ownership of the copyright is retained by the photographer unless outlined contractually. (and it's VERY expensive to gain full copyright) No one who has a car I've taken photos of owns any share of the copyright other than the verbal permission I've given them for purely personal use with no commercial gain.
Ok. It was not explained to this detail until now. Makes sense. I was not trying to be a dick. I just did not want people to keep submitting pics that were not eligible. It would only make more work for you and leave others scratching their heads in the long run...
After reading the rest...ultimately what determines usage rights is terms of contract. Keep in mind that the submiter sees no monetary gain and if the photog is a friend or enthusiast it should not be a big deal. But, it should go without saying that the photographer is aware of and agrees with his work being submitted.

I agree with you, but the calendar and photo contest is about members and their cars. If you took a member's car photo and submitted it as your work and enter this competition together, I think it's perfectly fair. But, if you are a professional photographer, went down to the race track and took pictures of an R8 that is not yours and that the car owner is not a member of Audizine, then what's the point? You'll be showing off your skill, but what prevents photographers from POTN (Photographers on the Net) from finding a random Audi on the road, creating an Audizine account, and diluting the effort of actual members and their cars.

Very good point, I hadn't considered the main purpose of the competition or the possibility of another random photographer. I was just thinking about the people in a position similar to mine; in love with Audis and have been a contributing member for over 2 years but am just stuck without an Audi at for a while. I would feel pretty jacked if the automobile had to be own in order to submit photos...
