View Full Version : another damn speeding ticket! fight it or not?

this is the 4th speeding ticket ive got with my b6 and it is the worst yet. 97 in a 65. the thing is i think it may have been 87 and the officer who was merging into traffic when his radar picked me up may have glanced down and thought he saw 97 but it was actually 87 which on the digital dash display could easily be mistaken for 97. also he said he clocked me when i was in the #3 lane but i was in the #5 lane. i was definately speeding going around 85mph but i know that i wasnt going near 100. there was a silver dodge charger in the #3 lane though my car is also silver and i think he may have mistaken my car for that. when i saw that the police had someone pulled over i immediately down shifted and braked a little but not very much and when i passed him i looked at my speedometer and i was going 80mph. obviously a little confused when he told me my speed was 97 i asked him if a plane had clocked my speed but he said that when i came up from behind him his car automatically clocked my speed.
so with all this being said who thinks i should fight this ticket? is anyone familliar with the process of fighting a speeding ticket like this? and i admit that i was speeding, around 85mph and my speedo reads 4mph higher than my actual speed. so even if my speedo said i was doing about 90 then my actual speed would have been around 88 or 87. so should i fight the speeding ticket all together or should i fight to have the speed reduced to 87mph? is there a difference in fine amount between 87 and 97mph?

always fight it!!! and yes the difference in the fine is fairly large but i think you should blame it all on the charger and go the whole way. how bad is your record?

well this will be my 4th speeding ticket, the worst being a 86 in a 65. so my record is kinda bad. ive had faster cars and i never had a ticket untill i got my b6 i think its cursed. i think i will try to blame it on the charger which was a srt-8 by the way

Your car isnt cursed, your just driving too fast. I would take the ticket and slow down.
From the sound of it, I dont think your story is going to get you anywhere, it will depend on if the judge believes it, but he'll most likely think your full of it.

i think you should stop speeding.. it's not really that hard to follow the limit most of the time.. or at least no more than 5 over

i wasnt asking if i should change my driving habbits or not. that has become painfully obvious. ive gone about a year sence my last speeding ticket. i was running late for a family dinner and was trying to make up for lost time spent in traffic and i was speeding. just not going 97. most of the time i wont go 10mph over. thanks for the advice but it isnt needed on that matter. so dont flame me for speeding because you all do it.
if anyone has any experience fighting speeding tickets i can use advice from you if youre willing to share it with me
Seeing as how you already have a bad rep, you are definitely fighting a huge uphill battle.
I argue b/c my record is pretty good. You, on the otherhand, stand a very very low chance of winning (not saying it isn't possible, just that it's not likely).
An officer's radar doesn't flash up a speed that quickly disappears. Some of them lock on to the highest speed achieved/recorded and remain until they clear it.
If he had a camera in his car (which just about every one here in MS does), your odds get even worse for victory.
What you could do though is go in to see if you can get the penalty reduced (claim a lower speed, even if it means still taking a speeding ticket). To the judge and insurance company (who you should really be concerned about), 97 in a 65 looks far worse than 7X or even 8X in a 65 (the X is for a number, not multiplication).
I argued a ticket of 96 in a 65 down to 75 in a 65. That reduction equaled about $300+ less in fines and an insurance hit far less than what could have been.

a lot will depend on the size of the town.. tickets are hard to beat anywhere especially one like that but if ur record is bad already it doesnt hurt to try, maybe an extra court cost of you lose, ive heard of asking the officer to be there esepecially if you insist it was the charger not you... if he doesnt show i believe they have to do it, but these damn small towns it doesnt matter
shit draw a diagram of the traffic and show how it was the charger not you, but i wouldnt admit any speeding, if u get off you will get off... ALL OR NOTHING

you should fight it becuase it cant hurt you. the worst that can happen if you fight it is you get the ticket.

thats not that big of a ticket I got a 97 in a 65 on 4/20 it says max speed exceeded 100+ and in the box it says 97 I just got it in the mail it's only$380
If you know any good lawyers they should be able to get it dropped for you.
